So, my wife and I just relocated to Texas for her to attend a graduate school. I quit my last job of five years to do so, confident in my CDL. Last week I went to the dmv and transferred it over, also adding D/T, Hzmat, and Tankers.
Got a letter today saying that since I had two serious moving violations within a 3 year period, my CDL would be disqualified for 60 days started at the end of Sept. Since then I feel kind of like Alice wandering through hell.
So, I called to get my speeding ticket information. One of the tickets, from December of 2009, was a 45 in a 30, but all this time I thought it was a 41 in a 35 so never really worried about it. I just know that I wasn't doing 45. My wife is a speed nazi, and if Id been doing that much over with her in the car, she would have kicked my ###. Anyway, I paid the ticket since I did know I was at least speeding 5-6 over, so I would be guilty regardless.
In July of 2010 I was called in to work at around 5am, so I took the interstate. This was i90 in Chicagoland, and the speed limit is 55, but most people do 80. I was probably doing around 70, so I was again at fault, and got a ticket for 75 in a 55.
So, in texas if you have two violations, even while not operating a CMV, you still get this disqualification deal.
So, a few questions among the many that are beating me in the head now are;
Has this happened to anyone else?
Will this be on my record? (This disqualify if it goes through)
Any chance that the judge at the hearing will throw it out since I haven't had any violations in the 3 years since, and it was another state? Not too mention all my bills. (ha..ha)
I'm working now to try and at least get the 75n55 taken off my record. The other will fall off in June, the guy at the Illinois DMV said, since there was no alcohol involved.
Any information any of you have would be greatly appreciated, while I go look for a job outside of my little tractor-trailer world.

the one from 09 shoulda dropped off....i would do some checking before i would accept that....but you gotta learn ...slow down..thats ur livleyhood......years ago....had a bunch myself. but it aint like it used to be.....and and speeding thru town??

The guy at the DMV said that it would fall off after 4 and a half years, so have until June for that one.
The one going through town was B.S. The cop got me in a 35mph zone (the speed limit in that town goes from 45-40-30-35-30-40 in the span of about two miles.) Still, yeah, I learned my lesson at some point in the middle of all that mess and have kept my nose clean since. Doesn't help me now though, unfortunately. -
You might look into hiring an attorney. Sometimes an attorney can get stuff reduced, or dismissed. It's going to cost you, but it may be worth it in the long run. Some attorneys specialize in CDL cases.

Makes no difference now whether it is in a personal vehicle or a commercial vehicle. The ticket has the same result.
As far as getting it reduced, they are not allowed to reduce tickets on CDLs anymore.LGarrison Thanks this. -
BigJoel is right...don't just lay down...Get a good attorney.WE ALL CAN RELATE, hope you know now how tough things are now. We all look like a bunch of blue hairs our here now..lol

Yeah, I've already contacted a few attorneys, and am planning on writing a letter to the judge, for whatever good that will do me. (Couldn't hurt, I imagine.)
As far as getting them reduced... I'm not sure what they do now, to be honest. I know a friend of mine from the last place I worked got let go from the job because of speeding tickets, we contracted to the USPS and you couldn't have 3 in five years, but he got them taken care of and was back at work within a month. -
I had one and my attorney fixed me right up...I think you'll be fine. And the letter...I think is a great idea. Sure wont hurt. Let the judge know you learned your lesson.

I thought the tickets fall off your record after 36 months? You should have a clean MVR by now.
