At the company I just joined on with, System Transport, this sales person for Open Road came to our orientation. He was going over the details of the plan, and when it came to legal protection, the plan's benefit was up to $1,000 a year. Now I don't know the exact prices of lawyers these days, but something tells me $1,000 might not be enough to fight a ticket sometimes.
Are there any better plans that give better coverage? I see those salespeople from TVC (Trucker's Voice in Court) all the time. Are they any better, or is their plan just kind of a hollow piece of paper that won't really save you any money when you get a ticket. I mean, after all, plan or no plan, you can always hire your own lawyer if it comes to it.
I'm heading back on the road soon, so I want to get something in place before then. Even if you usually can't get a ticket fixed, it's nice at least to know that the same officer that just stuck it to me will soon have to fill out gobs of needless paperwork. He'll share at least some of the pain, and if I'm lucky, then maybe I can force the state to spend more money on legal stuff than the value of the ticket.
I think states would quit trying to use CMV tickets as a source of revenue if every trucker hired lawyers to make them work for it. If it costs them more money than they're making, then it's not very profitable for them, is it?
What's the best legal plan to sign up for?

Check with OOIDA. They have access to some legal plans. The website is OOIDA.

You'd probably be better off putting 10 or 15 bucks a week into a savings account as a "lawyer fund." At least then if you don't need an attorney, you'll have something to show for it besides a stack of cancelled checks.

Stay out of trouble....I know that's easier said than done but these guys are hustlers. Don't buy into it. From what I've heard most of them are average attorneys at best and aren't exactly that committed when you need them. That's not my experience though but rather a friends. I would not pay for it. I got into trouble once in 17 years of driving and if you include the attorney and the fine it was around $1000.00 so you do the math. I look at it like this.....if you need to use this service a couple of times a year you probably won't be on the road much longer now with the CSA points, DAC and any other kind of tattle tale service government or private.

Best legal plan is drive as a professional, not like a Richard petty 4 wheeler. Remember u r the one getting paid to drive, act like it. The op david123abc is right on with his post. If u do have a heavy foot, or r prone to be overly aggressive, make ur own lawyer fund. If u dnt get into trouble u now have sum extra money for a vacation

CondoCruiser's safe driving plan is the cheapest and a lot less hassle.
If you ask for trouble you will find trouble. But you are on the right track of protecting that CDL. If you are halfway decent driver odds are you won't get in trouble but a couple times in your lifetime. If you work for a decent company they will help you with a interest free loan to pay the fine or even help with representation if it is serious.
Legal plans are just an excuse to drive like an idiot. Develop good driving habits and they will stay with you for life. Develop bad habits and they will help you find another career. These lawyers usually get the charges reduced but not always dismissed. You still acquire points on your MVR. Even if dismissed it still goes on your CSA2010 if a inspection was issued.
Another issue is who you work for. If you work for a company with a bad track record problems will be thrown in front of you. Work for a good company and you'll be less vulnerable. I went 12 years with a spotless record and then took a job with a fly by night company coerced into running illegal all the time. We were told in orientation that NE and IA had it out for them. They weren't lying. I never got so many inspections in my life and incurred two tickets in NE and IA. It was my fault plain and simple. But me working for that company put myself under the microscope. Kapeesh? It makes a difference. Work for a company that plays by the rules, drive safe and you'll never get in trouble. The paycheck is still the same.Lady K Thanks this. -
TVC blows. Their idea of being your voice in court is to plead guilty for you. You still get the points, you still get the fines, but now, you have to pay them, and they normally hit you for 3x what the original fine was.

With the internet nowadays you can find your own local lawyer. Some even advertize for tickets.
Back in the day when fuel was $1/gal and I lived in the left lane, interstatetrucker.com got most of them reduced to non-moving. Laws have changed but they were the best back then.
I don't have legal plan for at least 10 years now but don't get tickets either. -
One way to beat them at this game is to conform better to their rules, so they can't ticket us. But another (perhaps better) way, is to make them jump through so many legal loopholes, that by the time they actually are able to collect the fine, they've spent so much money on their own lawyers that the fine is actually too little to make up for it.
Deprive the states of the profit incentive, and they'll stop trying to crack down on us so hard.
1) - He can seek the full penalty, but if he does.... the defense attorneys are going to file a bazillion motions, and silly paperwork requests for every tiny detail of the case, which will require the prosecuting attorney's office to eat up manpower (and therefore money) answering those requests, until at the end of the trial they'll have spent $10,000 in order to collect a $500 fine.
2) - He can allow the defendant to plead to a lesser charge with a smaller fine (maybe $50), and they won't fight it at all.
Which option do you think a greedy city or state government is going to opt for? -
What's the best legal plan to sign up for? Don't, save the 40 bucks a month up in your own legal defense fund and hire a serious shark if you get in trouble.
A legal plan is about as good as a public defender. I'm not an expert or anything but my wife worked for a law firm for 4 years and that's what she says.fr8te_sh8ker Thanks this.
