Want to make sure I have this right.
This means that the max we can load a trailer and be legal going down the road is the following and still not be overloading the 52,000 GVWR of the truck?
- The GVWR of the truck says 52,000 lbs.
- The Front axle capacity says 12,000 lbs.
- Rear axle capacity says 40,000 lbs.
- 40k+12k = 52,000 lbs.
- Max hauling on our authority is 80,000 lbs.
- Typical tandem axle capacity on a 53' dry van is 34,000 lbs
If I was to haul such that I was at capacity of the axle ratings of the truck and the trailer (12,000+40,000+34000 = 86000 lbs) I would be 6000 lbs over weight according to what my authority says I am licensed to haul. The truck can do the extra 6000 lbs but I cannot legally haul it.
- Front truck axle = 12000 lbs
- Drive axles = 34000 lbs
- Trailer tandems = 34000 lbs
- Total weight hauled including weight of truck + weight of trailer + weight of the load = 80,000 lbs

Your truck has 40000 pound rears but you can only put 34000 pounds on a closed tandem regardless of the rating, you can go 40000 on a spread tandem.
My Transfer can be legal on every axle and be 7000 pounds over on the gross at the same time.
You can buy a permit to exceed the 80000 pound gross limit in some circumstances but it is a permit good for one load only and usually comes with specific routing instructions, when I ran lowbed I was at the permit office every day buying these.
These are the California restrictions anyway, but there are many who think the Federal rules apply in every State, those guys get tickets in Californiabottomdumpin Thanks this. -

To the OP, you are forgetting the weight of the truck and trailer are also included in the GVWR.
