Total Quality Logistics has to pay overtime to 4,500 workers, judge rules (yahoo.com)
The lawsuit describes the grind of legions of workers arranging TQL shipments as “junior logistics account executives” and trainees who were “’strongly encouraged’ to work sixty hours per week, work on Saturdays, attend after-hours training shifts and be able to receive calls on nights, weekends and holidays.” Witnesses in the case testified the company churned through young employees with a 60% turnover rate.

That’s pretty much right up there with the FedEx lawsuits where the company tried to say the owner/operators were “contracted employees” and were ineligible for wages!
F*** around with wage laws and find out!!

I think this was going on in pretty much every industry. I was involved in the oil industry when it started to shed light on this about 8 or 10years ago. Said it when I first started and they laughed at me. I got paid every hour I worked in the end. I kept very detail records of my hours and work including work locations. Was very easy to prove they classified me wrong. Tried to make it like I was a CDL job even though I never had a CDL and only drove to the sight and back but worked 10-20 hours on sight at a time. Was a slam dunk case just like this one.

In my last career I was a put on a salary after being an hourly guy for many many years. I learned every law about the salary positions at the time because I did not want to be on it. Old company was correct on putting me in as a salary guy, taught me a lot about those kind of situations.
