TQL - Not paying

    What can I do:

    I had 2 loads with TQL, both were delivered and both were signed with clean BOLs. Now receiver is claiming on 1 of the loads, that some of the product is missing and I been waiting for them to recount for the past 2 months. TQL is not paying for that load and holding payment for the 2nd load.

    What are my options?

    Clean bills? File on bond. They by law must pay you before they can collect on a claim.

    Yep, clean BOLs. I mean I can understand if they hold for the load they are potentially claiming but holding money on the load that has nothing to do with the claim is ridiculous.

    Contact their bond company on Monday, contact the corporate office. Raise holy hell, you'll get paid. Find out who's in charge of the office you're dealing with. And start being nasty.

    Lots of brokers have in their contract, that they can withold your pay until claim is settled. If by law they are required to pay, how does it work out with your signed contract?

    If you press the issue the law supersedes the contract.

    Clean bills trumps whatever they are trying to claim now. If there was an issue with the load it should have been settled and noted on the bills prior to signing.

    Threaten to file on bond and if you don't have a check in reasonable time, file on bond. Tell them if you aren't paid by day x, you are filing, and also that after this phone call you consider the matter out of their hands and you won't be calling again, for any reason. Call your insurance agent let them know what is happening. Keeping them in the loop real time will help you. They will say "clean bills. You received it without problem. Not our fault you misplaced it in your warehouse." At which point they won't pay out.

    They might have signed or stamped the BOL in a mischievous way. For example, I often see, that they put a generic stamp by the signature which says something like "subject to be counted and verified", however, from my experience, my understanding is that in case of shortage or blatant damage, a driver (you) must be present to verify and confirm that such occurred indeed, for you to be liable by law. So if you did not witness the receiving of the product (counting) confirmed by your signature and especially that your BOL does not have any ... little annotations then I don't see that they could screw you.

    I had a load booked with those jokers through my personal dispatcher ready to go today...but my "gut" was telling me to back away for the past 3 days so that's just what I did. I gotta listen to it or shame on me. I'm bobtailing 1300 miles to get a trailer for a customer of mine. I know how much it will cost me now. I wouldn't if I took that TQL load. Just my stubborn way of doing things I guess, but that's why I like my boss...he agrees with everything I say.

    Is this your first load with TQL? Our first load they tried the same thing , but we have OOIDA. insurance and they called on our behalf and everything was settled within 7 days. Now we have pulled over 100 loads for them with no problems.
