Ever noticed how many trucks are parked on the shoulder of the Big Road with their curtains closed? How does this happen?
Driver is motoring along, gets tired hits the shoulder, pops the brakes, closes his curtains, jumps into the sleeper, grabs binky, curls into fetal position and goes to sleep. What’s wrong with taking siesta on the side of the highway, right?
So Moron D Trucker is sleeping on the shoulder and Dufus Drunk did the Icky Shuffle out of the bar, gets into the car, hits the highway going shoulder to shoulder, almost makes it home, but slams into the back of a rig parked on the shoulder. Dufus gets killed. Can anyone tell me what happens to Moron D Trucker?

Seriously, I would imagine that Moron D. Trucker would be held liable for being a road hazard. And not having triangles out nor having mechanical failure.

First, they get charged with parking illegally (most states post signage that says shoulders are for emergency parking only, and nap time isn't an emergency). Even the regs say you have 10 min to put out you're warning devices (triangles). If someone hits you and there isn't debris from your squashed triangle(s), you didn't have them out at the time of the crash. Landstar would terminate your lease agreement if you were spotted on the shoulder of a road OR ramp without your triangles out.
2nd, Moron D. Trucker(and his company if he works for someone) gets sued by the family of the drunk. It happened to the original CFI many moons ago. Driver was parked on a ramp sleeping. 2 twenty-something girls were coming home from a party, passenger was passed out, driver was drunk and fell asleep at the wheel, lost control went off the road and slammed into the parked CFI killing the passenger, and injuring the driver. Because the truck driver didn't have their triangles out, the family of the drunk passenger got $18 million. And this was before the mega millions that juries are awarding nowadays.
If I were a trooper and I saw that nimrod on the shoulder without triangles, 1st thing I do after parking behind them with my disco lights on is check to see if he's o.k. and if I saw curtains pulled, call for a tow truck. Then when the hook is lined up, hooked up and ready to lift, then ask Mr Moron to exit the vehicle, and have it towed and he gets a little piece of paper with a fine amount and a court date if he wants to tell it to the judge.Last edited: Mar 18, 2022
