Run out of hours while stuck in traffic?

    I was stuck in traffic (dead stop due to rolled vehicle) and was nearly out of hours on my 11. Luckily they got it cleared and I was not in violation, but it was very close. How do you handle a situation like that, where you do run out of hours sitting in traffic?

    The "Adverse driving conditions" exemption allows you up to 2 hrs over your 11/14 if you encounter weather or traffic conditions that could not have been anticipated when load was dispatched

    How would DOT know if you are on the shoulder or in the middle of the road.

    The legal answer is like @kemosabi49 said. Just use the adverse driving provision and go on with life. A couple of caveats though. You have to stay on-duty as per the guidance. You also can't simply complete your trip. You have to stop at the next safe parking. It also has to be unforeseen. Daily rush hour, construction, weather, and such don't count. A wreck closing the road would tend to though.
    Now practically, I'd do what @JoeTruck suggested and go off duty. It's not legal, but the way I look at it if I'm sitting in the sleeper watching a movie or on the side of the road bs'ing other drivers I'm not working.

    So as far as the eld is concerned, I just make a note of it and it'll just count down into the negative...?

    And when you get stopped add a note saying "road shutdown due to accident, using Adverse Conditions extension to find safe parking". If you don't note the violation yourself, or if you don't add Adverse Conditions, it's just a plain old HOS violation. The ELD will still show the violation and there's often nothing you can do to correct the ELD, all it does is count to 11 or count to 14. The regs allow a 2 hour extension for adverse conditions. Rush hour traffic, is not adverse conditions. Shutting down the road is an adverse condition. I always made sure to take my full 10 hour break once I got stopped with the extra time driving. Few things create bigger problems than coming up short on your 10 hour.

    Weather significantly worse than expected or forecast before you started the trip counts as adverse conditions. Moderate rain in the Spring may make traffic move slower, but it's not adverse conditions just because some new drivers feel like it's the end of the world to drive in rain.
