I'd remove both and replace with milk crates for the added weight savings.
To answer seriously - if it's your truck, go for it. If it's the bosses - ask him/her.
Many LTL companies specced trucks with either a fixed non-air-ride seat, or none at all.

my last company charged me for the price of the seat to remove it from the truck. the biggest issue I could see from dot if you put a refrigerator there it should be secured somehow. but dot really don't care about the inside
