I have several questions that I need to ask. In order to ask them, I'll have to give a little bit of history. My husband has two felonies and two misdemeanors on his record. The felonies are 16 and 18 years old, the misdemeanors are 13 years old. He went to work for Cypress Truck Lines that operates under TLC-Transport Labor Contractors. (He had to be approved by Cypress and TLC since TLC does the Worker's Comp, payroll, etc.) Anyway, he left Cypress in order to try to get better benefits for our family. He went to work for PGT and wasn't satisfied there. He left there and went back to Cypress. They approved him, but for some reason, TLC wouldn't. He had only been gone from Cypress for about a month. Could this be considered discrimination since TLC had approved him before? They do not have a no rehire policy. Nothing had changed on his criminal record, however, we do not know if there was anything negative on his DAC report. We do know it was clean when he left Cypress. We have requested a copy of his DAC report and are waiting on it.
Now, he's trying to find a job with somebody-anybody that will hire felons. What good companies out there will hire felons? We really need some help on this. Thanks.

I have no experience with this - I want to be clear on that from the outset.
However, from your story, I'd suggest it has zip to do with ancient history. It's more likely that they're seeing your husband as a job-hopper, and just don't want to deal with it. I think you'll find that quite a few of the major players will take this attitude.
All I can say is "keep plugging away". -
One question, How old is you husband now. You didn't mention that. -
HazMat shouldn't be much of an issue as long as the crimes weren't weapons/ sedition related. The cutoff for anything else seems to be 7-10 years

These crimes are only disqualifying if they are considered felonies in the appropriate jurisdiction, civilian or military.
You are disqualified from holding an HME if convicted or found not guilty by reason of insanity within the previous 7 years or were released from prison in the last 5 years for any of the following crimes:
May be Eligible for Waiver/Appeal
- Unlawful entry into a seaport
- Assault with intent to murder
- Kidnapping or hostage taking
- Rape or aggravated sexual abuse
- Unlawful possession, use, sale, manufacture, purchase, distribution, receipt, transfer, shipping, transporting, delivery, import, export of, or dealing in a firearm or other weapon
- Extortion
- Dishonesty, fraud, or misrepresentation, including identity fraud
- Bribery
- Smuggling
- Immigration violations
- Violations of the Racketeer Influenced and Corrupt Organizations Act (RICO) under 18 U.S.C. 1961, or a comparable State law, other than any permanent disqualifying offenses
- Robbery
- Distribution of, intent to distribute, or importation of a controlled substance
- Arson
- Conspiracy or attempt to commit any of these crimes
You are permanently disqualified from holding an HME on a state-issued CDL if convicted or found not guilty by reason of insanity for any of the following crimes:

- Espionage
- Sedition
- Treason
- A crime listed in 18 U.S.C. Chapter 113B - Terrorism, or a State law that is comparable
- Bomb threats
- Crime involving a transportation security incident
- Improper transportation of a hazardous material under 49 U.S.C. 5124 or a comparable State law
- Unlawful possession, use, sale, distribution, manufacture, purchase, receipt, transfer, shipping, transporting, import, export, storage of, or dealing in an explosive or explosive device
- Murder
- Violations of the Racketeer Influenced and Corrupt Organizations Act (RICO) under 18 U.S.C. 1961, or a comparable State law, where violations consist of any of the permanent disqualifying offenses
- Conspiracy or attempt to commit any of these crimes

We found out that TLC turned him down because they were afraid he'd be a liability. He had to take some time off over a year ago due to a non-Cypress-related injury to his shoulder. It was bothering him long before he took the job with Cypress but finally went to the doctor about it.

No, he's not a job hopper. He was with Cypress for almost two years and the job before that (non-driving) for nine years. Granted he didn't stay with PGT long, but they didn't have enough freight to keep him busy. -

Hey everyone, need some help. I have a CDL class A, and im a student driver. I have haz mat and doubles/triples. The only strikes against me are a speeding ticket in 09, 2 points. , and 4 failure to pays on my three year. I tried to fight the tickets in trial for harassment, took a year an a half to go to court. I lost, and had to pay the fines, I paid them on November of 07. Now they are stating that as the day of when they fall off my history. I was cited in 05 and 06, because of this there is no major carrier that will touch me. the only ones that will pay a 26 Cent split, thats 13 cents to each driver. That is extortion, plus it is a company that is notorious for screwing up you DAC. I am asking people that have felonies, because I do not but you guys find people that give second chances, need help bad or if I do not find something in the next 60 days I will have to pay 1200.00 for the refresher. PLEASE HELP

I have 3 felonies and I have got to be blunt and honest.
Unless your husband is being asked to bend over for gay sex by the boss he had just better keep his job.
I've some school to finish but man with my job history and the fact many companies trucking and otherwise just can't see past someones past has me thinking of sticking it out for a few years, even if its CR england.
