Question about the 70 hour/8 day rule

    Ive been driving over 10 years and have always understood the 70 hour/8 day rule to mean that you can't be on duty for more than 70 hours in any rolling 8 day period, but that you can drive more than 8 days in a row as long as you don't go over 70 hours in the last 8 days. My new boss, who has been driving over 30 years tells me by law you have to take 34 hours off after 8 days regardless of how many hours you have accumulated. He thinks it's 70 hours OR 8 days, whichever comes 1st. I'm pretty sure I'm right, he's pretty sure he's right. Who's right? By the way, he's cool, so if I can show him that I'm right, he would accept it and not be a jerk. If anyone can backup their answer with proof would be great (I can see how the FMCSR could be misinterpreted his way). Thanks guys!

    On this page of FMCSA, it says a driver 'MAY' restart, not 'MUST'. I'm looking for more specifics on it.

    You are right, you can run as many days as you want as long as long as you don't run over the 70 hours in 8 days.

    I know some law enforcement people would lilke to see a restart but it isn't neccesary.

    60 hours in 7 days or 70 hours in 8 days = 34 hour reset

    we should make more and only work 50?

    But you don't have to do a reset if you have hours available. You can bump your 70 all you want.

    You do not have to reset. I also run on elogs so I know that it would have shut me down instead of letting me run 14 straight days last month. I will have to say its nice that it calculates the hours you get back for you at midnight instead of me making a silly mistake. :biggrin_25523:

    If you must take a 34, your 34 hour reset must contain one (1) chunk of time from Midnight to 6AM in it. Otherwise you don't have to take a 34 at all ever.

    How can you take a 34 and avoid the hours of midnight to 6AM? That would be a neat trick.
