That Publix truck didn't come to a complete stop.

Won't matter for the Publix driver. He made a split second (wrong) decision to not come to a complete stop. There'll be a lawsuit and it'll be argued that not stopping there might have been the difference between life and death.

Yep, three way stop at that intersection. I've delivered there many times. That won't matter for the truck driver though. If he'd stopped it might not have happened. He might have even seen what was coming and about to happen when stopped - then not pulled into the intersection preventing the crash. Or maybe the same thing would've happened either way. We'll never know. But not stopping at the stop sign will not go well for him in the wrongful death suit. You always gotta come to a complete stop. Always.

Oh, Dewey, Cheatum and Howe will have a field day with this. 1st, it's a shame a great outfit like Publix has to be called out, this could have happened to anyone. It doesn't look like a local truck, and an outside carrier. 2nd, it's entirely possible due to the pickup trucks speed, the driver simply didn't see them coming. One thing for sure, that took the pickup drivers head off. I'd hate to have to live with seeing that.

The ECM in the truck will be the determining factor of how much of a "stop" he completed.
It doesn't look good.
The other facts in the case, blowing the stop sign, speed of both vehicles, how the laws of contributory negligence are written in Florida and if they manage to impanel a sympathetic jury if it goes to trial be other factors in the final settlement.
My advice is for Publix to get out in front of this one and sue the pickup truck driver's estate first.
