I was leased on to a company and deleased my truck. I'm owed for 2 weeks pay plus escrow. I was expecting my check and payroll sent statement what I'm owed but also pay is on hold. Payroll says they have never returned escrow. I returned their GPS & all BOLs. Now owner, vice president & payroll have stopped taking my calls. They won't reply to voice mails, emails nor text messages. Any suggestions?

I think for payroll when your leased to a company they have 15 days to pay. As for the escrow they have 45 days to return any monies owed.

A good upstanding trucking co will play by the rules, A flakey co won't. An escrow account is for many reasons, usually so the co is ahead of you, not the other way around. However, upon leaving employ with the co and there are no outstanding monies that you may owe, they should return all escrow monies to the lessee. But this may take 30-45 days in case a bill comes in the the lessee owes.

Screw that, get a lawyer through the ooida and have them deal with it. They have 45 days to return the escrow and the interest that has been accrued because they are by regulations to put that into an interest bearing account, remember escrows are governed by fmcsa regulations and that is so not to screw the owner of the truck.

When you leased on, Kirch, what did your contract say about escrow monies and their resolution? Take a look, it's the only leg you have to stand on. Mostly.
