Off Duty Driving ?

    Just wondering how many use off duty driving to get to shipper to load ?
    Do you start your clock when your loaded and ready to go out the gate ?
    Do you use it to deliver the load and return to truck stop so you don't start your clock ?
    Does your company look the other way ?
    I know that all of the above is a falsification violation but am starting to see more and more of it each day.

    Any company that wants to look the other way would throw you under the truck when the Feds Audit the Driver Logs. Have you considered the consequences after the fact?

    At certain times it is perfectly legal, but then there is willful ignorance which is no excuse for bending the rules to suit your wants.

    My advise is drive your truck anyway you want as long as you are prepared to pay the consequences.

    Here is a newby that didn't listen at logs class. Blows a scale under load and using off duty driving.

    Yea, I see in a years time a very large number of companies will be not allowing personal use as the abuse will be getting them in trouble with both roadsides, and in audits.

    YUP... THIS.

    I have been setting up new AOBRD/ELD accounts basically 80% of my day right now because the deadline is getting close. And what you said here is already a pondering point NOW for everyone, even if they are just setting it up for themselves.

    When you set up the "parameters" for each driver on the device, it asks for "Allow Personal Conveyance / Off-Duty Driving = YES or NO." Then if you say "Yes" it will ask if you want to set a limit, like 20 miles, or 50 miles, or 90 miles, or unlimited, etc.

    Then it asks lots more, like:

    "Allow Yard Moves?" YES or NO.
    "Allow Rest Break Exemption?" YES or NO
    "Allow Adverse Conditions 2-hour extension" YES or NO
    "Hours of Service Exempt?" YES or NO
    "Allow 16 Hour Big Day?" YES or NO
    "Allow driver to change rules on the device?" YES or NO
    "Allow driver to correct lines (other than line 3)" YES or NO
    "Allow well site wait time?" YES or NO
    "Allow Hazmat load exemptions" YES or NO
    "Allow driver to log in from the web to do logs" YES or NO
    "Allow driver to switch carriers?" YES or NO
    "Require a remark at every duty status change" YES or NO
    "Hold incoming messages when driver is in Sleeper line?" YES or NO
    "Choose AOBRD mode or ELD mode"

    The bottom line
    is that there are MANY decisions that need to me made in the admin area which basically effect that driver's life out there using it, yup. Personal Conveyance is just one of many of these things. And a properly built system allows these parameters to be changed for each driver and not pressed upon everybody as one-size-fits-all.

    I would be surprised if it last that long.
    The drivers have some interesting stories. Especially the older ones that have problems with a TV remote.

    So for someone new to hauls that will put me at my hour of service limit when IS personal conveyance legal?... If I hour out 2 hours from home across a state line and 2 ports between me and home can I use personal conveyance if not loaded?

    Your wording here is a bit gray. So just re-ask differently if I don't answer what you were asking exactly.

    However, if you are unloaded and are "released from any company-related business" at the moment - then you could drive home those 1-2 hours using the PC mode if your company allows in the Admin settings of your ELD, yes. If you are driving to a shop to get the truck worked on, then no. But if you are going to your home (or even hotel) then yes.

    A first my company said if you have an empty trailer you can go off duty driving. Then the FMCSA man said that it would be up to the officer weather you could off duty drive with a trailer. He added that FMCSA views that trailer that is empty as a load. Their would be guidance forthcoming we were told. almost a year has passed I might add. Now the company is saying only when you are BT can you off duty drive.
    I see many who off duty drive to load and start their clock when they are loaded and going out the gate. I also am seeing that off duty drive to load or unload during their 10 hour break and return after loaded to finish the 10 hour break.
    On another note if I stop and go off duty for 30 min break I can move truck without setting off a violation. But if I go off duty and flag rest break it will send a violation to the company.
