Need Advice: I'm an O/O and just got a DUI

    Gee...FORTH offense and then WI gets serious...COME ON!

    By the way...
    I am presuming he got the DUI in MO. Not WI.
    It was in a personal car. So while his CDL will be trashed, he would not fall under the same rules as a driver in a rig that was popped for DUI.....
    RIGHT?

    And remember a CDL holder is not eligible for a "occupational" license anymore,...The first offense will cost you your job,...

    This is when WI gets serious:


    • A fourth offense Operating While Intoxicated (OWI) will be a felony if it occurs within five years of an earlier offense.
    That was my point. We have one of the WEAKEST laws of all of the states. Live here if you want to drink and drive...:biggrin_25510:

    It's worse if you are a cdl holder,...

    It will cost a driver his driving job,.....If a driver is lucky his employer will have warehouse work for them to do,....After a year you can get your cdl back, and then you still wont drive unless the employer allows it,...

    So it's not a FELONY until the fourth offense,...

    The first one will more than likely cost you your driving job,.....

    You are responsible for the cost of alcohol assessment classes,..

    Its his first offense !!

    He wants real time advise from similar cases..........

    Hire a driver for your truck !!! You can still ride with him !!!!

    The exact same thing happened to my brother in law about ten years ago. He went and talked to a lawyer and the lawyer got it to where he could only drive for work. He is also an Owner Operator. One other thing is he cannot go to Canada.

    I'm pretty sure the Federal Laws regarding a CDL have changed since then,,

    The occupational license of the past is no longer issued so a CDL holder can drive at work,....

    A occupational license may be issued to allow someone to get to and from work and only during specified hours of the day,....

    It happened to a friend of mine a couple of years ago,...He lost cdl for one year,....But was given a occupational license to get to and from work. The local company he worked for allowed him to become a drivers helper and he also worked in the warehouse fro that year,...He was not allowed to drive at work,...He was lucky as most companies will send you packing in that situation,...
