My brother wants to be a trucker so bad that he's even too afraid to call someone and ask because he thinks they will take his information down and never hire him. He got a misdemeanor for stealing a necklace for my mom for Christmas. He paid off all of the fines and this happened 3 months shy of 5 years ago. Also he thinks he is too out of shape because he is overweight and has high blood pressure, but he's only 24. He heard somewhere you had to take a physical test and be fit enough to drive. Do you think Swift would turn him down? What should he do?

A misdemeanor won't stop him . On the BP if it's higher than 140/90 he should gets meds to get it lower than that . That will qualify him with a 1 year card . Higher than that he will get at most a 3 month card to get it treated .
It would be best to be tested for sleep apnea before getting a physical . If he can show he has been tested and can certify that it will clear him .
If he does have sleep apnea and can certify effective treatment he should have no problem being qualified .
The best thing to do would be to lose weight so a doctor would not suspect sleep apnea .

The misdemeanor is not going to be an issue as long as he is honest when applying. Even felonies aren't an issue in most cases.

Regarding his weight I think RickG's advise is absolutely correct. He really should concentrate on eating healthier and losing weight anyway. Something to consider is that when you are training at Swift you are over the road with a trainer for 5-7 weeks. You will be sleeping in the top bunk. Getting into the top bunk requires a bit of athleticism. While I've seen a fairly high number of overweight truck drivers, I can say that being agile is a very good thing for a trucker. Recently I watched a Swift driver that was within the first two weeks of post training, getting his truck into a dock at a shipper. This particular shipper required the tandems to be set to the back before getting into the dock. It required the trucker to get out and unlock the tandems, get back into the truck and move the truck forward, get out and lock the tandems, open the doors, back into the dock, then get out and chock the wheels. By the end of this very simple exercise, in hot and humid conditions, he was beet red and sweating like he'd just stepped out of a shower. A job that would have taken me about four minutes took him about twenty minutes.

Whether he gets into trucking or not, getting fit is a good thing.

If he has weight issues, sitting in the driver seat of a van will only make things worse. I would suggest flat bed (I'm with TMC) I was out of shape when i started but the hard work of flat bedding got me in shape pretty quick with no additional excessive. The first few weeks were hard, but you get used to it. We sit in the driver seat a lot to, but the tarping, strapping, chaining, etc makes up for it.

apply for expungement and see what happens. dui's can normally be expunged after 10 years. pot possession is 7 years. have no idea about his case.

does he smoke??? stopping for a day will most defenitely lower it. i have to go 4 hours without a smoke before doing my exams. and at 4 hours. i'm passing by 2 points. if i'm off for the day. i'll go in first thing in the morning before having that first cig. gets me about 110/70.

and follow the others advice for his weight.

RickG had the best advice. Get that BP under control along with a sleep study. If he's overweight now trucking is not going to do him any favors.

Contrary to what others say, Swift does not hire everyone who applies. They are willing to take your money and run you though their Academy which I'm sure is a money maker for them. I've been with Swift since Oct. of last year and most of my problems have been created by myself. As with any large company Swift does have issues.

I don't believe the misd. will be an issue to get hired. There were several guys in my class who had the same problem and never got questioned about it. One guy was even convicted of battery while he was driving for Swift and nothing was said. He finally quit and went to another company who never said a thing about his recent conviction.

misdemeanors and arrests usually go on case to case review. stealing a neckless doesnt seem to bad. shouldnt have any issue. just as long as he dont start stealing boxes out the back of his trailer he should be ok

in utah, it goes on a timeframe. you submit your fingerprints and $10. get your wrap sheet. wait 30 days for the letter. go back. get one document. take to court for judge to sign and pay the document fee for extra copies. hand them out to all the divisions. wait 30 days. submit fingerprints and $10. get your CLEAN wrap sheet.

most misdemeanors are 5 years. pot pessision is 7 years. dui is 10 years. and that's date from last arrest. so if you got more then one. you had to wait the full time frame from the last one.

there is no case by case. there is no going to the court or hiring a lawyer. i did my procedure twice.
