Not quite sure how this works. I had a accident last year , my first one and it was on the job and it sadly was a fatality. I was NOT at fault. I didnt receive any citations or anything. 2 months later another truck driver rear ended me in my work trailer for him passing a stop sign.

When i apply for a new job will these accidents come up on my MVR report ? And if they do will they show I’m not at fault ? Also when applying and the company’s ask clean mvr ? Do i say Yes or no? And if asked if any accidents do i say yea or no? Given some jobs soon as they see yes on application cross you out without consideration or explanation of situations .

    TIA !

The employers and industry generally divides accidents into Preventable and Non-Preventable. In most cases you cannot prevent some bad driver from running into your parked truck so just analyze the accident and see if there is anything you could do if the situation happened again. Once you have done that, just remember those extra things you will do from now on and don't dwell on them. If the other person involved didn't do what he could have done to save his life, all of the mis-placed guilt in the world won't bring him back, but it can ruin your life. Don't let someone else's mistake ruin more lives than the bare minimum, you aren't helping anyone.

Get a copy of your MVR. My state charges $7 and you can get instant report. Do the same for your FMCSA PSP report ($10). Get a copy of your DAC / Hire Right Report which I think is $15 and you may not get any report for 15 days even if you pick the email option. When I last got my report they charged me the fee, I selected the email instead of snail mail report and then 14 days later I got a link via email to see my Hire Right report.

If you are involved in any accident and insurance companies pay that accident will be in an insurance company database. Never lie on a job application, but ONLY answer the question they ask, not the question you are afraid they MIGHT ask. In person, if asked if you have any accidents, I would answer according to the MVR/PSP/Hire Right report and then ask if they are asking about people hitting your truck? MVR's generally show at-fault tickets and violations on your record, not vouch for other things. Companies will have more info on you, if they want it, than the answers you give them. Often they are comparing your answers to what they see in those other reports. Stick to the facts. Get a very brief explanation about ANYTHING in your background and don't make it a 3 hour sob-fest. "I was once rear-ended by another driver and he died, I wasn't at fault, I got no ticket, there was nothing I could have done to prevent it." Some brief description suitable to your situation is what they want to know.

You are hirable at lots of companies. Keep your record clean, but you cannot prevent everything.

You can't control what some employers do with information. You don't need most jobs or every job. You need one job at a time. Don't turn a problem into the worst problem because some company you wouldn't want to work for won't want to hire you, if that is even true.

Most ask for copies of the PD report which could be problematic with the fatality though some will release the basic standard report instead of 20, or more, pages with large sections 'redacted' with black magic marker.

You always want copies of any PD report involving your CDL; I've hired a bunch of drivers with two acidents when limited to one 'at fault' when they had the PD reports to pass on to the underwriter.

Drivers with 'not at fault' fatals still work; I've seen a few.

Had the pleasure of not hiring the one who should be considered 'at fault' later at another company where he omitted it all on his app.

That was a few years later and he was working 'cause his falsified background wasn't checked by most port companies and we had never been together throuhout the accident where the hit was just under 400K and I just wouldn't....

Thank you so much for all this information. Can i get all of those reports from the same page? Your information was very helpful , they don’t teach you all this information in school when i went a few years ago and i never had an accident until this situation so never thought to ask until now.

Just a few days ago I was able to successfully obtain a free copy of my DAC report using the info from here: Get Your Free DAC Report - TruckersReport.com

Filled out form. Received email to setup an account with hireright the following day. And one day after that, received confirmation that my account was setup. You login to what looks like an email inbox and select your report. Instructions for password to open the attached pdf are in message.

Note: I requested all of my information and used the [from DD/MM/YYYY to DD/MM/YYYY] encompassing my entire commercial drivers license period -- make sure you use the format in the brackets (it doesn't have to be exact if you got your CDL in June 5, 2015 you would use 'from 06/01/2015 to 08/24/23' for example. Totally free and quick. One free a year? So, similar to getting a free credit report annually.

No, you cannot get those reports at one page.
    PSP Report
Google "get copy of MVR" your state. Only visit your state's official web page for the MVR

Because the Hire Right (formerly DAC) people are treated under Federal law like the people that run credit bureaus, you have the same rights with Hire Right as you do with your credit report. You can get AT LEAST one free copy per year. Your state may allow more than one report per year. You have a right to challenge any inaccurate info in that report. You also have the right to have a brief statement from you included and passed along to any company seeking your report. You will need to search the Hire Right.com website and follow EXACTLY their procedure and stick to the length of the statement or HR will not include your statement. There are lots of posts on TTR about Hire Right / DAC.

I hope to never have to request a police report (fingers crossed; no incidents to date). If I should ever be involved in a serious incident that requires a police report, is this something that I obtain at the scene/event? Or do you have to follow-up at a later date to procure this documentation? Thanks!
