    I just want to tell you about a company called Midwest Logistics out of North Liberty Indiana. They are one of the worst companys to work for. The reason why I worked for them for 10 months I had never had 1 Ticket or an accident and they let me go. Because I passed the general manager on the Highway. They put on my DAC That I am a unsafe Driver. Now I can't even get a job. I have been driving for 21 yrs. It takes a life time to get a good record and only one company to destroy it. Don't let This company be the one to destroy you.:biggrin_2553:

    I never heard much good about them. They advertise daily in the local papers, what does that say? They're tied up pretty tite with AM General, move a lot of freight in and out of there.

    I would almost guarantee that isnt why they let you go--you may think so. But they cannot put things like "unsafe driving" on your DAC that is not backed up with a ticket. ALso like I have said here before on hese forums--There is only 2 things that they can put on you DAC as to why they fired you and that is that you "failed a drug screen" or you "recieved too many points on your license"
    All others they have to list under the part that says whether they will or will not rhire you either with or without a review when they do. Unsafe driving can only be determined by a law enforcement party not the company itself. They can deal with this internally, but not as part of the DAC. There are a lot of things that comapnies can threaten to put on your DAC, that they just cant put there.
    Also, most companies go on a case-by-case basis when they hire anyhow, so that couldnt affect you as far as that goes. If you order your DAC(which, under law, you have the right to order it once a year) you can see what is actually on there and then you can dispute all or any of it, the company then is at the burden to produce facts and if they cant DAC must remove it.     Lol yeah I know...me again. But your wrong here too.

    companies can put darned near anything on DAC reports. If you read this website long enough, you will see that rather quickly. Tickets, accidents, drug screens, truck abandonment...etc...just to name a very few of what they put on there.

    If there is an issue, yes you can fight it...but then you have to back and forth with the company via DAC and all that...and good luck getting it taken off. if anything, you can write a response to the company's action on your DAC...so that potential employers will see their entry, and your response.

    D- i would start the process contesting this with DAC...do you know specifically what they put on there as far as the entry?

    Actually I am not wrong and can prove it, and have done so here on these boards. You may think you know it all, but the facts are that they CANNOT just put any old thing that they want to on there. We have been over this discussion on this forum many times, and if you read through thes you would know this instead of thinking that you know it all. If you would actually pull your DAC(which by law you have the right to do so for free once a year) you would know this. I have pulled mine evry year for the past almost 8 years that I have been driving. BTW, it is not even DAC it is actually USIS.

    Tickets and accidents come from your state BMV reports(which are not always up to date either), Drug screens come from your employers. And of course Truck abandonment will be on there, since according to DOT, this is a chargeable accident. But a company CANNOT put on there that you are a unsafe driver unless they have a ticket from a law enforcement agency(since they are the obnly ones that can determine that) to back it up, and then it would be in the state BMV part of the report. Once again, a company cannot write on there that you were fired for "unsafe driving" . The facts are that it will just say the following " driver terminated or lease broken" and then it will say by either the company or you and then it is up to you to explain why, not the company, if you are asked.They may be a able to put that you were "terminated for failure to follow company rules, but that is it, you must supply what rules that you broke. The only thing that the company can legally put on there as far as why you were terminated is that "you failed a drug screen" and "that you violated company rules" or that you cannot be rehired with or without a review.
    Most of these people that say that a certain company put something on their DAC, is because the company threatened to do so. But just because they threaten does not mean that they can. Most of these people that say that the company put it on there, have never even seen their DAC and have no idea what it looks like or are even aware that they are entitled to a free copy of it once a year.. Sorry, but here you are wrong and alll you got to do is order yours and you will find that out since a explanation actually comes with it.

    Like I have told you, just because you dont beleive something, does not make it Not true. ALthough it appears that in your mind that it does.

    Well its pointless to argue with you here because you already gave up on the other discussion we were having. The fact of the matter is that DAC is a severe issue for many drivers out there. So much so that there are programs such as DacFix which help a driver restore their report. Which is silly because of it was such a n easy thing to do...and there wasn't as many issues out there....there wouldnt be a need for such a company. However, DAC is messing up drivers left and right and all the time I hear of drivers getting them filled with issues such as truck abaondonment and other things. Either way, the problem with DAC is that they report what the company says, and in the end, the companies word rules. If they allow the companies version, then you get to put your lil disclaimer on there as well. The company can fire you for any reason, as we already know and they can manipulate things so much that its a nightmare to remove / fight the issues. And then what..at the end of the day, its the drivers word against the company...and if you are a recruiter going over someones DAC report...are you seriiously going to take the drivers word for it?

    Well, the original point is that he was let go because he "passed the GM on the highway". Anyone that believes that is a fool! I realize there are some petty policies in effect with alot of these companies but, this is most likely a case of a guy who is never wrong and always being treated badly by the man. In other words a perpetual victim who is never at fault.
    With "21 years" in this business you'd think a guy would move past that blame game nonsense by now but, guys like this always prove that trucking isn't brain surgery.

    You have been driving for according to you "1 year" My guess is that you have never even seen your own DAc or even know what it looks like, but then again(as before) you think you know it all and everybody is wrong except you. Thing is that I have proved on these forums that DAC is held to(by law) what or what they can or cannot say on you DAC, whether you believe it or not. In fact when your prospective employer calls the company to verify your employment they can only(by law) tell them 4 things about you. 1. Yes or No you worked there, 2. the dates you worked there, and 3. whether or not that you failed a drug screen.4. Whether or not you were terminated but not the reason why(since that must be supplied by the driver) If you dont beleive that then call your state's attorney general and ask him. Also only 22 states(right to work) can fire you for any reason and without an explanation, the other 28 have to give one or have a valid reason. Only 8 states have to give no reason for termination when you collect unemployment.

    So "yes" I would listen to what the driver was saying--they do when it comes to accidents or incidents, why wouldnt they on this? I really wish that you would quit commenting on stuff that you really dont know anything about, but yet think you do--why you have picked me to do so is beyond me. Another guy did something similar to this and he has been banned from this board for doing so.
