Okay so my husband was with a company before who had him take a sleep study which of course he failed. He has seen his regular doctor about it and she's further investigating into it... during this sleep test they made him sleep on his back most of the time which he is not used to and he's a big Guy so its not so easy on him. Eventually he was told he didn't sleep good on his back but did fine on his side and when he asked the doctor how long he stopped breathing for he would not tell him yet told him the Guy next door stopped breathing for two minutes? According to the "results" it said he had 37 occurances that he had stopped breathing. Obviously we have gone to his regular doctor in town abt this and she is further investigating it since he can not sleep with it and we have no income what so ever... he's going to orientation with a new smaller company soon and had planned on saying he doesn't have it if asked and telling the truth abt sleeping that he does sleep fine and feels fine everyday energy wise ect which is true and I as a partner have never noticed any sleeping problems nor not breathing in his sleep but I know I'm not alwats awake and watching him. We currently have no insurance but when we can get some back we plan on getting him tested again. Anyway he tried going on with Crete and they would not accept him since he was not 100% compatible with the machine for 6 hrs every night ... they also would not accept the doctors note about further investigating it. My question is if he goes to this new company and they ask abt it and he says he doesn't have it or they don't ask and he just goes on with it what can happen? Could they find out? In the mean time he plans on getting retested but until then idk what to do or say I don't want him to get in trouble for lying or not saying anything but we literally only have $60 left to our name we've paid rent for this month (April) and that's it. If he can't get a job BC of this devilish machine that a lot of people can't use were screwed! I personally think that machine is ######## for some yes some who can use it OK but also with the company who gave him the machine he told them over and over he couldn't use it maybe he needed a bipap or new mask or something they never listened. Either way he was going to be fired for not using it. Should he just go and not say anything abt it?

If you "fail" a sleep study - ie you were diagnosed as having sleep apnea..... you MUST be compliant with using your CPAP or you are disqualified from holding a DOT medical card.
Just so you know.... intentionally failing to disclose a medical condition that affects your ability to operate a CMV to a DOT medical examiner is perjury and a federal Class I felony.
There is a driver currently serviing 7 years..... one year for each person who died in a probably non-preventable accident.... that did not tell a DOT medical examiner about "failing" a sleep study and was not using a CPAP.
This is not something to try to get around. If you have been screened as being high risk as having sleep apnea.... given a conditional medical card to get a sleep study or have "failed" a sleep study.
Don't risk jail... do the right thing. There are a lot of us OTR that have been using CPAP for years. It can be done.CondoCruiser, mje, 48Packard and 1 other person Thank this. -
Maverick just started testing for sleep apnea. Not only will they pay for the test if you need it, they'll even buy a new machine for you up front and do payroll deduction until its paid off.
Dunno how many other carriers are doing that, but I know some are telling potential drivers that its their own responsibility to pay for everything.
If he has at least 6 months OTR experience in the last two years, he'll get hired in as an experienced driver at a high pay rate.

He's protected by HIPPA from his medical info being shared without his written consent. But a driver has to disclose any known medical conditions on his DOT medical long form. If he hides it an gets in a fatality wreck which can happen to anyone, a thorough background investigation will be done and that would be used against him. So a driver needs to be straight forward to protect himself from being sued in case the inevitable happens. One can slide through the cracks but why chance it? It's an expensive gamble.
Besides all that they are finding out sleep apnea is some pretty serious stuff. Not just the quitting breathing thing but it leads to many other serious health conditions later in life. Trust me I know first hand. The best thing to do is get treated and get compliant. It's best for his job but more importantly his health. Many have problems adapting to a Cpap but eventially get use to it and wouldn't have it any other way when they do. He doesn't realize his problem because it very slowly gets worse over the years. So much for medical records being sealed. Great now the governments going to find out I'm a homicidal maniac who spent 10 years in the loony bin for ripping the head off my stretch Armstrong when I was a kid so I could see what was inside him. This is ridiculous sleep apnea is bull crap. My brother in law has it and works for the rail road but doesn't have to worry about that crap when he's driving a train. Just pathetic in my opinion

Well what if it never comes up he doesn't say anything or if it does he lies then is test with a regular doctor and comes back that he does not have it? Will they find out if he has as long as nothing happens?

As one of the above posters said, he'd be committing a felony by not disclosing a known condition on his DOT form. It's not worth risking it. If his employer ever finds out, even through a routine check, he'll be fired instantly.
Lying about a condition which can affect operation of a CMV is playing with serious fire. I really, really wouldn't recommend it. Also, if he does have it, he doesn't need to be driving a truck if he won't use the machine, its too risky.mje Thanks this. -
Let's put being compliant aside for one moment. Your husband could die. That's right. Sleep apnea could kill him. This isn't something to take lightly. He needs to get on a CPAP machine and see a doctor. You're asking the wrong questions here. You need to ask who a good doc is or how can I get my hands on a CPAP machine. Like yesterday.
