I doubt most of the people that sign the CRST contract even read it. You have people on here all the time asking things like "can the company do this?" or "I leased onto company xyz. can the charge me for...?" etc. Most of them never read their contracts and if they did, they didn't understand the legaleese in them.

Wow just Wow maybe some jerkoffs in upper management in Cedar Rapids should buy a clue if you regularly have newbies bail out for Swift. Just how bad are you treating them?

I think @ZVar put it well. The driver signed a non compete agreement until they paid their debt. Swift should know that because I imagine their"free" training has a similar contact. They should not take people still in debt to other companies.

Interference with a contract. Have you never heard of the Pennzoil vs.Texaco case? I'm surprised and a bit dismayed that the court allowed this to be applied to an employment contract though.

If I were on Swift's legal team I think I'd be subpoenaing the logs for those drivers and trying to show that CRST committed some kind of infraction. That might get the contracts invalidated.

    The hell?

Their defense should simply be "we're bigger and better" --- being the (objectively) biggest would make them an obvious candidate for anybody looking to jump ship, and being (supposedly) perceived as better would cause that naturally

This "they're not trying to fill jobs, they're just STEALING OUR SERFS" thing is straight-up medieval bs.

If a guy quits CRST and get a job with another trucking company, CRST will send a letter to his new company with a copy of the non compete thing the driver signed. They will threaten to sue if the new company allows the guy to keep working. Pure BS. Other companies, like Swift will try to collect what they are owed from training the new driver, even send it to collections. But they will not try to keep the guy from working.

More like Driver A is defrauded by Company B after recruiters materially misrepresent the actual working conditions and pay, then Company B is not merely satisfied with wrecking Driver A's life, they want to sue anyone who offers a refuge so Driver A can earn a living and eat.

The ATA and its members need to be put out to the hogs.

I have a question to anyone who works/has worked at these companies. Aren't they kind of all the same? I haven't worked for either and my only knowledge of them comes from reading on here but it sounds like they are pretty much the same thing so if you are gonna starve and be miserable at one you are gonna starve and be miserable at the other. Why go work somewhere else that isn't any better and owe someone a lot of money and/or screw your credit up?

Swift will appeal and win...and sue for legal costs as well, and get those to.
