JH Rose Logistics Scumbags

    Hello all,

    I have a situation with J H Rose Logistics. In December 2018 we transported a load from VA to NC for them. The shipper Cloverleaf cold storage loaded and sealed the trailer and we delivered to NC receiver. Turns out that about 24 cases were missing. They are blaming us for not delivering exact amount as stated on BOLs. So they charged $528 from the load because cases were missing. We did not steal them it was someones mistake not loading correct amount, it happens. I don't want to pay for someone miscounting the cases. What can I do? I have filed with their surety bond. They denied the claim due to transported commodity not covered by bond, its was chicken. There was no where on confirmation stating that driver has to count the cases. I have called the shipper and asked them "are the drivers allowed inside the warehouse to count the cases" answer was no. It is a cold storage, no one in their right mind will stand there and count all the cases being loaded for 3-4 hours. I have tried talking to agent and corporate office and they are saying since we signed for the amount on BOL we are responsible for the everything missing. This is a first one for me, usually if something is missing then they just bill different amount to the buyer. Can someone tell me what should I do about this.

    Maybe writing on the bills, before driver signs, Shipper load, Shipper counted. Why do you say no one would stay in freezer while shipper loads because its too cold? You already stated driver was not allowed on dock.. Was it driver didn't want to stay inside and count because it was too cold? Learning experience. I don't think cargo insurance covers this,but you might want to check that. Let us know what happens, I would be interested in the final outcome. Thanks

    I have called twice already to Cloverleaf cold storage, both ladies that worked there stated that drivers are not allowed inside the warehouse, and one lady said that no one reported missing cases to them. I recorded both calls and send them to JH Rose, but they want a letter from Cloverleaf stating that drivers are not allowed inside the warehouse. I dont have to prove that we didnt steal anything, thats why there is a seal on the trailer.

    I know $528 is not a lot of money but I am getting tired of brokers always want to make a trucking company at fault. So I am thinking filling a lawsuit against them. No matter what the out come will be, I will know I tried everything to defend myself and my company.

    I'm guessing that you did not have the seal verified by the receiver in my opinion your fault!

    Ask them to come out check the seal and sign the bill's seal intact ,all issues with count fall back on the shipper that put the seal on ,that's what's it's for

    Does the BOL state that the load is carrier count, or shipper count? Did you break the seal or did the receiver? You need to get it in writing that driver's aren't allowed on the dock, but if the shipper screwed up that should be on them. It's happened to me that a shipper loaded an extra pallet of one product and was short a pallet of another, and the extra pallet was rejected. Customer correctly blamed the shipper, paid market rate to have the truck come back (!) with one pallet because they couldn't find a local cold storage option and didn't want to just write it off. Sorry this happened to you.
