I've had 2 beers, how long before I can drive again?

    Just looking to see if anyone has any info on regs or laws as I am just curious about the time needed after being out or at home having a drink to legally be able to drive CMV? Thanks.

    4 hours is the limit.


    §392.5 Alcohol prohibition.
    (a) No driver shall'
    (a)(1) Use alcohol, as defined in §382.107 of this subchapter, or be under the influence of alcohol, within 4 hours before going on duty or operating, or having physical control of, a commercial motor vehicle; or

    when you have none in your system. Their is no generic answer, just like "I only had 2 drinks". Your drink may be 12 oz and mine drink may be 22 oz. Each person's metabolism is different. Each person's body processes the booze differently. What may take me 3 hours , may take you 5 hours. It depends on how much food someone has consumes and if the alcohol readily is absorbed through the walls of your stomach or if it's soaked up by some sort of food in your belly and is absord at a slower rate. Way to many variables to give you any kind of answer. Best advice, don't drink at all in you plan to get in your rig and run a load. I personally have seen to many the last few months driving a tractor trailer who have been drinking.

    Our company policy: 8 hrs from bottle to throttle.

    I thought it was no alcohol at all in the 4 hours preceding coming on duty or the performance of any safety sensitive work provided that the driver's BAC was below 04.

    A driver can not have a detectable presence of alcohol on his breath or person. Here's the portion of the regulation.

    §392.5 Alcohol prohibition.
    (a) No driver shall—
    (a)(1) Use alcohol, as defined in §382.107 of this subchapter, or be under the influence of alcohol, within 4 hours before going on duty or operating, or having physical control of, a commercial motor vehicle; or
    (a)(2) Use alcohol, be under the influence of alcohol, or have any measured alcohol concentration or detected presence of alcohol, while on duty, or operating, or in physical control of a commercial motor vehicle; or

    Here is the CVSA out of service criteria pertaining to intoxicating beverages:

    10. INTOXICATING BEVERAGES

    Under the influence of intoxicating beverage, consumes an intoxicating beverage
    regardless of its alcohol content, or have any measured alcohol concentration or any
    detected presence of alcohol while on duty, or operating or in physical control of a motor
    vehicle. (Consumption - 392.5(a)(1) or Presence/Influence - 392.5(a)(2))
    Declare driver
    out-of-service for twenty-four (24) consecutive hours.

    Be on duty or operate a motor vehicle while the driver possesses an intoxicating
    beverage, regardless of its alcohol content. (Possession - 392.5(a)(3))
    Declare driver
    out-of-service for twenty-four (24) consecutive hours.

    Driver violating any roadside out-of-service order regarding intoxicating beverages.
    (392.5(c)(2))
    Declare driver out-of-service for twenty-four (24) consecutive hours.
