Is it legal to have alcohol ON a truck?

    I know it's against the law to transport even sealed alcohol inside the cab. But what about strapping a case of beer to the catwalk? I thought about that the other day when I was bobtailing home from work. I decided not to take any chances and made a second trip later in my car.

    We were told no. Even a gift-wrapped bottle of wine is illegal. That’s what my company told us.

    i do believe it has to be manifested. and in the trailer, no place else.

    unless that has changed

    so i'd say NO.

    Alcohol should be consumed not hauled!

    Question 3: Does the prohibition against carrying alcoholic beverages in §392.5apply to a driver who uses a company vehicle, for personal reasons, while off-duty?

    Guidance: No. For example, an owner-operator using his/her own vehicle in an off-duty status, or a driver using a company truck or tractor for transportation to a motel, restaurant, or home, would normally be outside the scope of this section.

    And just a thought. Truck drivers will give you every constitutional reason that they have no right to stop you, legal advice on how to get out of a ticket, pontificate on the merits of a drug free life........

    When you have a legal question ask the folks writing the rules and you are 100% guaranteed a correct answer.

    You aint the first or the last to think of these things.

    And I was taught how to drink and drive a semi by a trainer back before the 1991 cdl laws. Go figure. Literally a different set of times and culture in those days, no one gave a ####. The reasoning was no airride and in certain tractors with seat bolted to floor and to frame you needed something to ease the 300 miles of bad concrete prior to the large replacement projects such as 78 and 81 in PA once upon a time. I recall in Ct on I think rte 8 that was being replaced, I needed a few sips to attempt several bridges that had the beams just wide enough for steers and inner tires over the water but not yet decking installed. And a couple other things. (I have since checked those bridges three of them I think over the years and saw that the bridges were doing fine. Considering how new they were then)

    I understand you cannot even have mouthwash alcohol. Anything that can cross into your body in some way and then to your brain and alter it is no. Even hand sanitizer back in the days before they started putting in a percentage of gasoline based product to make it not so .. enjoyable for humans.

    Im sober several decades myself. Drinking does not reward like it used to because the ones I have a taste for is literally outlawed in my state for a variety of reasons dating to the early 1800's Something to do with root liqours or other. I'll have to do some research. Maybe that is a good thing. That spearmint schnapps is really a good medicine for what ails you with a shot or two. That's all it takes.

    Check your company policy, too.
    They may have a total ban on alcohol in/on company vehicles, in company-paid motels, on company property, at company functions, and so on.

    You might be an O/O though, in which case.....disregard my last.

    Just to jump on the dog pile,,,

    You drink OUTSIDE of your truck (say,,, Applebee's) then hit your sleeper bunk, you never start the truck you don't even sit in the driver's seat, local LEO stops by and knocks and asks you to step out for anything,,,

    Bam, DUI charge. Loss of license. Permanent ban.

    It's what I was told. Is it true? I'll let someone else find out then post here with, "boo boo hoo, I lost my job because I had tequila with my tacos!"

    So, should I call law enforcement if I think somebody parked near me has maybe had a drink while at Applebee’s?
