I'm sure the answer lies somewhere in the million threads regarding regulations but I HAVE to get a load picked up today and my carrier is having trouble finding someone with HAZ endorsement. I don't think it's required on class 9 loads but I can't find the actual 49CFR ruling. HELP! Thanks

Does it require placards?
If not, you dont need hazmat.
If it does, Im pretty sure you need it for class 9. -
Hazmat applies to anything reportable or requiring placards. It is possible for you to haul a LTL load that is not reportable.

Class 9 does NOT require placards according to 49CFR. So..does that mean the driver does NOT have to be Haz endorsed? It's UN3072 btw...it's not a Marine Polluntant.

Ive never had to worry about it, since Ive always had a hazmat endorsement. Do not take my word as law!

Thanks, Harvey. I won't take your word as law but I think you are right. Sure wish the freakin' book was more clear. Leave it to the government to make the regulation so convoluted that Einstein himself can't make head nor tails out of it.

(b) Endorsement descriptions. An operator must obtain State-issued endorsements to his/her CDL to operate commercial motor vehicles which are:
(4) Used to transport hazardous materials as defined in § 383.5,
383.5 Definitions
Hazardous materials means any material that has been designated as hazardous under 49 U.S.C. 5103 and is required to be placarded under subpart F of 49 CFR part 172 or any quantity of a material listed as a select agent or toxin in 42 CFR part 73.
172.504(f) Placarding exeptions
(9) For Class 9, a CLASS 9 placard is not required for domestic transportation, including that portion of international transportation, defined in § 171.8 of this subchapter, which occurs within the United States.
