After going back and forth with safety regarding my logbooks.. he has given me the ultimatum of doing it the "right" way or hand in the keys for refusing to comply. The argument was about sleeper berth not being counted into your 14 hour clock. He is insisting and stances by his claim that sleeper berth does count if you're in it for less then 8 hours but if you are in sleeper berth for more then 8 hours then it does not have to be calculated in your 14 hour clock. My stance is that I can use sleeper berth and off duty time at any time and will not count into my 14 hour clock at all. Only driving & on duty/not driving does. He also claims that we legally have two hours to log off duty and that wont go into your 14 hour clock.

you have accomplished your 10
or all 10 off duty if safty isn't anal
but 2 hours off 6 sleeper 2 off

Once you drop down to line 3 or 4 your 14 hour clock starts. If you go back to line 1 or 2, the 14 hour clock is still counting down.
Easy way to figure this out. You start at Midnight. Jump ahead to 2pm. This is the end of your 14 hour day.
Unless you do a split sleeper, once that 14 hour clocks starts you cannot stop it no matter what line you are on.mustang970, Raiderfanatic and flood Thank this. -
Both of you are wrong. All time counts against your 14hr clock. The only exception is the period of at least 8hrs in the sleeper berth you take when you split your break. There is no 2 hour break that doesn't count against your 14.

Under the new rules, he is correct. That is why everyone is in such an uproar about it in Washington, as asinine as it sounds ANYTHING ON LINE 1OR 2 that totals LESS THAN 8 HRS CONSECUTIVELY counts against your 14.

Page 15 answers your question exactly. It is not what you want to hear, but it is the law for now. Everybody is contesting, and studying, all of the new rules, including the new 1 34hr restart every 168 hrs. Apparently to much rest is bad for us too. -
Your safety man is right, and you are wrong. Small sleeper breaks will not stop the clock. Even if you took four separate 2 hour sleeper breaks in the 14 hour period, your clock stops at 14. You need a minimum of 2 and 8 to stop the clock, but your better off taking the 10 at one stretch, because it gets real hard to stay within the 14 if you always split it up.

So just curious why you doubt the safety professional that works for your company? Has he given you any reason to doubt him/her? Otherwise you're just creating a bias against yourself. If it's gotten to the point that they say do it the "right way" or hand over your keys I would say you've created an unfriendly environment. Since I don't know your safety person you may either already be on a slippery slope to getting the axe, or they'll just let it slide. If you want to stay and they're forgiving people you might want to go eat some humble pie and apologize and starting doing it their way, or start looking for alternatives.

The 14hr clock does not stop unless you take 8 in the sleeper. Simple as that.
