Hazmat w/ Felony Arrest

    I’ll try and make this a short story, although, that's easier said than done.

    I've had my CDL since 2014, but I do NOT have any indorcements and I'd like to get my Hazmat. I'm currently in the USAF Reserves and last year was charged with sexual assault because I fooled around with a girl at a party (everybody was drinking) and then she decided she regreted her decision, and in fear of her boyfriend finding out she decided to say I assaulted her.

    I've had to hire a civilian military attorney to fight this, but it has yet to go to trial and until it does and I am able to get aquitted I cannot even think about getting it exponged. My backgroubs currently says I was arrested for felony sexual assault, but I haven't been convicted, obviously, since it’s still pending trial. Is this something that would get me disqualified from aquirring my Hazmat in TX? Please help!

    I'm not a lawyer, so do some Google searches on that matter.
    I think though that felony sexual assault is a permanant disqualification.
    Don't take my word though, because that's not something to assume or take lightly.

    Is that for convictions- or charges to? I ask because now a days it seems that even charges show up. Didn’t it used to be only convictions that showed up?

    Forget the Hazmat.

    You have a trial to attend to. In some ways it';s good that it's a military trial but on other ways it's not so good anymore because Military is being made to share convictions with big data so that when you are discharged in any form, you will learn that you cannot buy a gun etc.

    Everything you have worked for in the Military is on the line, Your future VA Benefits, medical care and so forth. If you are convicted of sexual crimes, you will have to register and cannot live within about 3000 feet of any church, daycare, schools or any sporting area with children etc. You will learn that covers many many towns and you will have to accept that you will live among other offenders in their neighborhoods as well with your information easily found online to anyone with a Google Search.

    I hate to be difficult. But this is very serious. Bigly serious. If the Court cross examines her and she is made to recant her accusations against you for fear of retribution from the boy friend you have a fighting chance at acquittal, do not make any plans for anything until that gavel bangs on not guilty or guilty and so on.

    People will try to give you a hard time and make light of that one list posted by Moose1958. But I have a copy of that list on my desktop just like I carried a copy on my green regs book while trucking most of my life. Which was partially one of the reasons I did not come across too many females in my life time. I was to meet some who are otherwise suitable but because of my CDL and so on I could not place at risk in a party situation as you described.

    At some point in the future I intend or hope to live long enough to make a explanation to two gals in particular whom I chose not to carry the friendship into the realm of lovers and so on. That is just a couple of loose ends on my part, no trouble anywhere. And eventually I got married. Even though we are divorced now, we are a team. Breaking a circle of hate and bad feelings between both sets of our parents.

    Ive said enough. All I can do is tell you to prepare for battle in that courtroom. And when you fight, you must fight like a lion making his kill with no regrets. You will learn soon enough who your real friends are.

    You can probably expect this thread and other social media posts you have made already about this case elsewhere online to be summons and collected to be used against you in some way. I like to believe that Justice still has a set of scales that weights pretty good to this day but technology such as this kind of communicating is a real liability to you right now.

    There is two of your answers. The first. Forget about any plans for Hazmat and trucking in general. Second fight in that courtroom. Don't sit meekly as if you were a child caught at 2 am with hand in cookie jar waiting for parental punishment. This situation is a very deadly serious one and if the courts are what I think they are, they should bring that false accusation to light from that girl. If they don't break her, then you are finished here.

    You can get hazmat with a felony conviction of a nonviolent nature. You cannot get one if you are waiting on a trial, have a warrant out for your arrest, or a certain violent crimes, anything to do with drugs in a vehicle, and a few other things. Good luck to you.

    Based on that link, looks like he can qualify for the hazmat since he hasn't been convicted of a crime. Should that change he would more than likely be required to give up the hazmat.

    I have my hazmat with an old felony but it was listed on my record as still being open when I got the background check. I had to hire a lawyer in the state I was convicted in and have them correct the issue before I actually got cleared. You’re going to have to beat the charge first or do your time and be completely free from probabtion or parole.

    And being under indictment, guilty or not, I wouldn’t be posting about it. Surely your lawyer told you to #### and not talk to anyone about this.
