Have you been fired due to injury while working for JB Hunt? and denied benefits.....

    the reason why I am asking is because I have a friend who was injured back on October 2006, by unwinding the tractor-trailer. he immediately called safety and followed their procedures from A-Z. was told to take a drug test, go to closet clinic or hospital and not leave without faxing back all necessary paperwork JB required or he was terminated.

    he found out that he had an ACL joint separated from his rotarcuff, was told not to return to work until an ortho evaluated him and MRI was taken, of course, he was on med's.

    He has been denied all benefits. Texas being an at-will state, says it all. oh and that ERISA thing, forget. there weren't any lawyers who wanted to touch it without having at least $6,000-$12,000 just to start. No money, come on, who are they kidding. this is ridiculous.

    can i get any feedback from anyone who got fired from JB and ran across similar problems?

    here's a question I have for most of you truckers: how many times has your trailer been inspected in a year or maintenance on it? ie, the landing gear and handles, etc. you get the point.

    i'm going thru some interesting #### with them right now. i came in for time off last thursday night. i went to the dentist on friday for pain and was told i had to go see an orthopedic surgeon as soon as posible to get it taken care of. he personally couldn't do anything because of DOT rules and violations. not sure exactley what he meant but am looking into that for a more direct answer on why not or why that is. called my fleet manager this am and basically got a line of crap. he was telling me to reschedule the appointment for a later date. i told him no. i am on codone for pain and an antibiotic for the infection and got two broken molars. he kept giving me crap about the truck losing 500$ a day while sitting over and over. i was so p'o d by the end of the conversation that i just got off the phone. i have decided to call his boss tomorrow morning and safety about this situation and report his behavior.

    Well in 95 I had a back problem with them (J.B.) and since they are self-insured, or were, with AIG, they denied my claim and we had to go to court to get our settlement. I dont know what "at will state" means. Seems to me that if he has a valid claim that a lawyer would take it on a contingancy basis.

    Dont know what you mean by ERSIA thing, J.B. has a pretty good disibility insurance program if the workers comp wont go through.

    J. B. inspects their trailers on a pretty regular basis but....lots of times if the landing gear is messed up nothing will be done if the previous driver has not wrote it up and no one knows about it, and the mechanics dont go around the yards cranking on landing gears

    well for those of you who don't know, ERISA means that JB is self insured, they don not carry workers comp in Texas and when i said "at-will-state", that means they can fire you for any reason.

    but since they have ERISA, employees stand somewhat of a chance as far as trying to get whats rightfully yours, there is an appeal process, which leads into arbritation, not the whole court thing.

    now if neither parties come to an agreement, then it does go into court later on after that.

    texas happens to be a state that if you are working today, tomorrow you don't have to be working. your employer can fire you for any reason and they don't have to tell you why.

    now this to me is certainly wrong, but it happens.

    what my friend and i are trying to do is find other truckers that have worked for JB, got injured while employed by JB and then turned around and got FIRED by JB? we want to know what happened and what is being done right now about it.

    Contact OOIDA and give them the particulars. Have your friend join them. He can submit a complaint against JB Hunt and OOIDA will look into it. They are very helpful. Many times OOIDA files suit against a company. Good Luck

    Well now I get the "at will state". Even though they can fire you without a reason, they would still be liable (I believe) for the injury if it happened while on the job, anyway good luck with it all.

    he worked for JB Hunt as a company driver, never did owner op., can he still look into OOIDA?
