Hail Damage, Ins. Co, and Carmack,

    How many here have had a hail damage claim and how was it handled.

    I've never had a hail damage claim but on the back of our inspections it states that loss, damage or injury caused by an act of God, the public enemy, the fault or negligence of the Shipper, public authority or the inherent vice or nature of the shipment.
    Those things and many others are not liable by the carrier. Exhaust systems breaking causing damage fluids etc from vehicles. Things like that.

    Hey SX, yeah we have the same on our bill of lading, and in over twenty years I have had exactly two hail damage claims. One about 12 years ago that my insurance company at the time DID cover.

    And now one from last weekend in Neb, on I-80, unfortunately it was 2013 Escalade, we dropped it at the dealer, and then my insurance company called me to say it will be considered act of god and not covered.


    Now, this was a one time drop for us at this dealer, of course he was upset, and to be honest I can't help but feel bad about it. But it did get me to wondering, what if that had been one of our million dollar a year accounts? I pay good money for insurance that is (thankfully) seldom used, but I would hate to lose a large account over something like this.

    Check with your insurance provider before you have a claim. If your policy doesn't cover what you think it should, find out if they offer a policy that does, at a reasonable price. The cheapest policy you can find isn't worth the money if it doesn't cover what you need covered.
    If you only get enough insurance to cover your legal obligations, you may need to pay for some items out of pocket. Those million dollar accounts come to mind.

    Hello eeb, I have good insurance, always have, in fact we are over insured as far as damage/liability for what we haul, that's not the issue, the issue is the Carmack clause and it's a effect of act of god occurrences.
    I don't care how much insurance you have, or who you buy it though, if they have a way to get around paying a claim, they will, that money comes right off the top and insurance companies don't pay for things they don't have to.

    Well, there you go. May have to pay out-of-pocket to protect accounts that are worth it.

    But then you have to charge for that within the rates. Which is fine until the customer goes shopping & does not care or realize the value of
    someone willing to cover acts of God.

    If your standard rates on that account won't allow you to cover the occasional act of God, the account must not be worth it. If the account's paying over a million a year, shelling out a couple grand a decade doesn't seem all that unreasonable to keep a good customer happy. Your business, you decide what's reasonable.

    Although to a point I can agree with your premise, if it was a hail storm like we had, and all new vehicles you would probably be in the 20,000 dollar range, on a 10 car probably closer to a 100,000 the cars on the top row would have been totaled.

    I just wondered what other have done, apparently it is indeed a rare occurrence.

    Seems like the damage would have happened on your trailer or not. Hail would have hit it sitting on the dealers lot. On his lot his insurance would have picked up. I am looking at it as the dealer should claim on his policy ?
