I recently got nabbed in Fresno, south of Chestnut. I was cruising in the center lane with the "Trucks OK" signs, and then all of the sudden I get hit with "Trucks use right lane." It's 4PM with Fresno rush hour traffic, and I'm headed southbound. Put on my turn signal several times to get into the right lane, but the ####### driving 4 wheelers are passing me up at like 75 MPH. No time to safely get into the right lane. About 2 miles--3 minutes-- after the "trucks use right lane sign," CHP pulls me over in the SUV and writes me a ticket for failure to obey lane restriction.
This is the only thing on my record now (I haven't been 'convicted' yet), but I'm wondering how to fight it in court. Could I argue that I never had a safe enough opening to get into that lane?? Is there any chance of asking them to reduce this to a lesser, not-for-points offense? My driving record is absolutely unblemished besides this and I'm wondering how to convince the traffic court to give me a less-serious VC violation, or to dismiss it outright.

It's really nothing to worry about even though it's aggravating when you know it's just a money grab. 100's of thousands of truckers have gotten those tickets in California, including me. It's all about money. When the speed limit was 55 mph in Texas, I got a ticket for 56 mph. He probably needed me for his monthly quota, which doesn't exist.TallJoe and LoSt_AgAiN Thank this. -
Had the same at Water rd , I40, court was Joshua Tree.
Hired Cravens Law, only lawyer in the cess pool town.
$200, had it reduced to not obeying sign in an off road vehicle - no point violation. Plus $200+ fine.
As China said - money grab. I HATE California.

Get a lawyer , i just did the same exact thing .
I jumped in the left lane , the CHP materialized out of nowhere and nabbed me .
Lawyer got it reduced to "not obeying odd road sign " ,
No points , but i did have to pay a 248.00 fine. ( lawyer was around 400.00 , I ve since hooked up with one of those lawyer pool deals for something like 39.95 per month )

The aim is to get it reduced to a lesser charge,mor get it dismissed. I've done this a few times. It's kinda ironic but I've had great success when driving my truck, than I have during my private vehicle

Take a certified copy of your MVR, but don't expect it to carry much weight. Most people with an unblemished record have just been lucky so far.

in my thoughts any person who defends himself in court is not going to fare very well. most people are not trained to deal with that type of situation. i am not a big fan of lawyers but sometimes you are better off paying them to defend you in court. and protecting your drivers licence is a smart thing to do,seems you get one ticket then,one more and at that point you are in a little trouble with your license. hope it all works out for you
