Hi, i got a false abandonment on my DAC report and I did not abandon the truck. The company threatened me if I left they would put an abandonment on. Eventually they "changed their minds" and said they would not put an abandonment on.
They lied.
I really need advice here. I have been applying for work for three months and just recently got hired through a cdl temp agency (no job security, three month job).
I have a ton of experience and a perfect driving record, TWIC, all endorsements, hazmat, experience USING ALL ENDORSEMENTS.
Yet i've struggled to get a job when I would not have in the past. I would like to be able to line a up a GOOD job before the temp job period runs out.
I went online to hireright and ordered a copy of my dac. I know it's bad because when the temp agency looked it up i was there and they told me i had the abandonment. I don't have the money to pay that company that gets it "expunged" (with a "70 percent success rate") right now. They charge $189 for that... and it's BS because i didn't do anything wrong so why should i have to give up an arm and a leg to "clean up" my record?

I left the truck at a place where the company has trucks parked, they rent space inside one of their customers distribution centers.
It's an "unauthorized location" (but not really).
When my dispatcher told me that turning it in there would mean an abandonment I said I was willing to take the truck to the main terminal.
Than... they said because i was making a bad judgment call for leaving them that they figured i would be in an "irrational mindset" to be driving the truck back to the main terminal. I made it clear to them that if i was not going to take the truck to the terminal because they wouldn't let me despite being willing to do it, that they will not put an abandonment on.
It's their fault if they don't let me turn it in at an authorized location.
So... they agreed and said they would not put abandonment on my record.
Sure enough, they lied. They did. They wrote "turned in at unauthorized location."
That would've been what it was if i had initially turned it in there when they said that would count as an abandonment, but when they revoked my option of driving the truck back to the main terminal despite being willing to do that; than it's ON THEM.
How could i turn it in at an authorized location if they wouldn't let me?
There should NOT be anything on my dac regarding abandonment.
I was willing to turn the truck in to the proper location but they would not let me and agreed that since it was their decision not to let me that they could not put an abandonment on. They lied. -
It isn't going to help you a lot now but do some reading on DAC and turning in a company truck. If you part ways with a company, you should never leave a truck anywhere besides where you picked it up. You should clean it up and take pictures.
You should then take it to the terminal and get them to give you something in writing saying it was handled correctly. If they act like they won't, take more pictures in front of them so they know you have documentation.
In the future, don't communicate by phone. Use the Qualcom and get copies of the communication to document what you are told. I would have a small recorder to use if a company insists on cell phone instructions. I would tell them at the beginning of the conversation, on the recording, that I was recording so there would be no misunderstanding.
There are two lessons here that you need to carry forward. The first lesson is if you allow the relationship between you and the company to break down, they will always win. The second lesson is always document everything that goes on and especially if things are going bad.
The good news is you don't have to pay anyone to clean up your DAC. The bad news is neither you or a company that specializes in this process has much chance of success unless you can prove your position. If you can't document the instructions you say they gave you and the condition of the truck, there is little chance of getting this removed.
You can try this yourself. I would write a letter to Hire Right with all the details and ask that they correct my record by removing the incorrect information. Be business-like. Do not bad mouth the company or say they lie or anything else negative about DAC or the company.
When/if they say they won't remove this information; you have the right to enter a paragraph explaining your side. If you aren't good at writing, most of us aren't, find someone to do this for you. A good explanation could level the playing field.
In your other thread you said they wanted you to cool off. This is not information you want to share with DAC or another company. Nobody wants to hire a hothead. You should say something like, "We had an ongoing personality conflict that couldn't be resolved despite my best efforts." -
Hey Big John your advice is really good, here's a little more explanation though of what exactly went on. Though i may have sounded like a hothead, what happened is that i gave my 2 weeks notice but my dispatcher did not respect that.
They kept dispatching me and every time i told them I gave you two weeks notice two weeks ago they didn't care. They just kept me running.
Eventually i had enough. When you give two weeks notice that means in two weeks you have the right to walk away and say you gave your two weeks notice.
At the company i worked for... dispatchers LOOSE MONEY WHEN A DRIVER QUITS. Talk about an unfair bias to any driver who does quit.

You can dispute anything on your DAC, in writing. Then the company who put it on there must answer with their version. If they don't, DAC removes it from your file. If they do, then there are TWO versions in your file, yours and theirs. At least you have a fighting chance when applying for jobs.

Joe I should have been clearer in what I was saying. You don't know me well enough to know I do my best not to judge others. I try to live by the phrase "Let he who is without sin, cast the first stone." I never qualify for that job!
My statement was more about how it could be interpreted by someone. While it is not right, I think life often comes down to what people perceive more than what the facts are. With that in mind, a person needs to carefully choose the way they portray a situation. In doing this, you can find a more positive way to make your point. A smart person will get the message while you retain your credibility and their respect. The ones that don't get it do not matter anyway.
I really don't know what you do with a company that won't bring you in when you give a notice. I think I would remind them once and if that didn't work I would not say anything else. I would let them think it had blown over and wait for my chance.
While you may have a right to leave after they ignore your notice, you need to know it will turn out bad for your career. So you have to decide if shooting yourself in the foot is worth it. I don't think it is and I doubt you do now either.
The facts are when you go to work for a company; you need to know their practices. The only way to win is to play by their rules. My guess is this is the way this company does business and you should have researched and known how they played the game. With the proper information you could have made a better plan for leaving.
Did you send the two-week notice by Qualcom? Did you send it to management? Did you mail a certified letter to the company with your notice? You see where I am going. If you did not do any of these things and document them for your records, it did not happen. CYA is very important in today's society. It is especially important in trucking. I document and copy almost everything I do in any type of business.

There are 7 different abandonment entries. 9 reason for leaving. When i look at new hires and see an abandonment of any kind with short time work history at the company it goes in the garbage. Couple of years with the company and an abandonment(mainly one of the mega carriers)and i might ask the driver about it.
It might be a PITA but you need to keep up your end of agreement even if they won't. Guarantee the company will keep better records(proof) of your actions than you will have of theirs.Lonesome Thanks this.
