equipment violation

    I was pulled over last night about eight miles west of Hubbard, OH on I 80 because I did not have my head lights on. I had just left the Loves in Hubbard to fuel and get some coffee. I have to call the court tomorrow to find out if there is a fine. I know this is not a moving violation but will it effect my CSA. I already have two points for a flat tire. Should I plead quilty?

    Your best course of action would be to plead guilty, because if you were driving at night without your headlights then you are guilty. Just take your lumps, and yes it probably will affect your CSA. Why didn't you turn on your lights before you left the Loves?

    No driver/vehicle inspection report, then no CSA points. Fight every ticket, even a reduction is a win for you. Many courts allow trial by written declaration on infractions. No court appearance necessary. Google the vc # on citation and traffic court procedures in Ohio for more info.

    No CMV inspection, no CSA points.

    Equipment violation is what guys with speeding tickets try to get it reduced to.

    I doubt they'll reduce an equipment violation.

    Your only chance is go to court and hope the cop doesn't show.

    DO NOT PLEAD TO ANYTHING!

    Make the call then ask the person you talk to if they can give you the name of a lawyer. If not then do a search for one that does either trucks or traffic infractions.

    Your 1st interview is usually free so talk and ask what he can do for you. You can send him a check covering his fee and your fine and costs. You will not have to appear for court.

    NEVER just plead guilty to any type of ticket but take it to court.

    Just out of courisity, what time is on the ticket? Was it actually past sunset? Official time in Youngstown on 1/1/2012 was 1704 :1/2/2012 1705 was 1705 http://timeanddate.com/worldclock/astronomy.html?n=913&month=1&year=2012&obj=sun&afl=-11&day=1

    If the ticket isn't after those times I would first contact the DA and tell him the cop is wasting his time and yours if he can't tell time and he might drop the charges. If after do the lawyer.

    The reason why you do not just pay a ticket is if you really screw the pooch later in your career it can be held against you because you "just" plead guilty and paid the fine. It's a CYA move. Yes it costs more but it can be money well spent!

    IF it's after those times then you need to start doing a check list before releasing your brakes! Hopefully any rookies reading this will learn a pre release of the brakes checklist the same as a pilot does as that 32,000 pound plus empty truck isn't a little 4 wheeler!

    Headlights on 30 min before sunset(after sunrise)

    What time was that? I was out in hubbard last night and the snow was flying hard, visibility was sub par and I saw TWO not just one...TWO idiots without their headlights on around 9:30pm to 10pm...

    I have been guilty of this once or twice. Pulling out of a truck stop and a guy is backing in to a space in front of me so out of courtesy I turn off my headlights, then forget to turn them back on again.

    The worst part is I think the trooper forgot to return my license. He gave me the registration and the ticket and told me he would wait behind me until I left the shoulder but he did not. I realised that I did not have it and I grabbed my coat to go ask him but he pulled off. I looked on the ground by the truck before pulling off. Then I pulled over in a safe spot and searched the truck. I called the Ohio trooper dispatch and they contacted him. He says he gave it to me. I recall every detail about that night. I don't recall him giving me the license. Now my co driver is on a solo load taking us home so that I can get a new license. I tried to make a complaint against the trooper but that wont help me now. I spoke to a law firm and they told me to pay for the ticket because it will not hurt my license because there are no points and it is not a moving violation in New Jersey where I am licensed.
