ELD hours of service advice

    Be wary of Hours of Service advice being handed out from ELD manufacturers. One in particular (not to be named) is telling team drivers in vehicles without sleepers, that they can just log Off-Duty when riding in the passenger seat.

    Also be wary of following their advice on using Personal Conveyance.

    They are getting drivers into trouble out here roadside.

    Anyone with a CDL is required to know the regulations. Enter FMCSA and HOS into your preferred search engine. Following the advice of your boss, another driver, etc will not get you out of a ticket. Read the HOS regs, read them until you understand them.

    I don’t run team but you can’t run team in day cab that I know of. You need a sleeper so other driver can log sleeper birth for 8 hours and I might be wrong. It I think you can log 2 hours off duty in passenger seat, but you need 8 hours in a sleeper to be legal to make 10 hours off.

    Absolutely!
    The problem we see is with new drivers - and startup carriers - listening to the ELD people. Especially hot shots.

    The company I was leased to allowed drivers at commission Terminals to run illegal.
    ELD"s unplugged or just on ignore. All alerts went to terminal manager and was deleted.
    Mean while the company terminals were held to the letter of the law.
    Hot shots sleeping in their back seats is very common around here.

    Nothing illegal about hotshots sleeping in the back seat. No regulation says you have to have a sleeper birth. They simply log off duty if their back seat does not meet the requirements of a sleeper birth. This is for a solo driver, trying that with two drivers in a moving truck is different.

    Ah, next the FMCSA will require facial recognition cameras and fingerprint readers on ELD's to verify the driver that is logged into the ELD is the real person entering the drive time.

    I know of a few that use their truck owners ID when hours run short or just PC it.

    If there weren't people out here doing that sort of thing, there would be no need for such identification.
    However, you and I both know it happens. We see it all the time. False log-ons, ghost co-drivers, etc.

    I’ve heard of people using the local exemption staying within 150 miles of the home terminal. And they use loose leaf paper and when they go outside the 150 miles they say it’s the first time this month …..even tho they might do it 2 times a week…….
