Hi I'm new to the sight and fairly new to trucking but had a question for y'all, I run a company truck but also have a personal truck, now by the time I get in I'm out of hours. I herd you could run a personal bobtail truck with "not for hire" written on it without a log like any other personal transportation, anyone know if this is legal?

Bobtailing to the house at the end of your duties? Log it OFF DUTY at the time of your leaving, and if it makes you feel better, flag the time when you reach the house.

That was my understanding too - as long as you're not hauling a load, just going to the house or the store, you were fine.

Even with e-logs, if we have to go to the motel they tell us to log out of the system altogether and proceed.

It is called off duty for personal conveyance. The just of it is that you can't be under a dispatch, and the limit of how far you can go is up to the company. Example is my company limits is to 10 miles under this rule.

It's not my company truck, I park my company truck when I'm done with it this is actually my truck, so if I wanna take it for a Sunday cruise or something along those lines I still need a log but just mark it as off duty?

Is it a commercial motor vehicle under the following description.

Commercial motor vehicle means any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle—
    (1) Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or
    (2) Is designed or used to transport more than 8 passengers (including the driver) for compensation; or
    (3) Is designed or used to transport more than 15 passengers, including the driver, and is not used to transport passengers for compensation; or
    (4) Is used in transporting material found by the Secretary of Transportation to be hazardous under 49 U.S.C. 5103 and transported in a quantity requiring placarding under regulations prescribed by the Secretary under 49 CFR, subtitle B, chapter I, subchapter C.

If this truck is not designed to make money for you its not commercial, if you are sunday crusin and monday your gonna hook up to a trailer and make some money then the truck is commercial. now that doesnt mean if one read this that you didnt need a cdl. if you didnt you wouldnt have the license requirements to drive this type of vehicle. <<<<< thats for the people that dont know, i know you have a CDL lol. Example: a show truck with a covered fifth wheel or a obvious clue it doesnt do any "for profit work" then its not commercial, just requires a CDL to drive it. strange since a CDL means commercial drivers license lol.

He can slip by with personal conveyance but the way it's written is you can't advance forward towards a load. You can go anywhere from lets say home or truck stop as long as you return. Like one time I had to go to Savannah, GA to pick up a new trailer the trailer though empty was considered the freight. That's written in one of the DOT FAQ's. The same would apply with a truck. The truck is the freight but you didn't go buy it. But that's all knit picking. 5 states won't say a word than some butt in another might. Usually temp tag drivers they don't fool with. The truck got up there some how, you are just going back home from vacation as far as they are concerned. The not for hire sign is not necessary. A cheap piece of paper might look suspicious.

During an audit they have to be able to get a picture from town to town. You simply can't go off duty in town A and mysteriously go back on duty in town B. Flags are going to fly.
