They RECOMMEND a sleep study, thats all.If he passed the physical with flying colors, and got a 2 year card then let it alone and maybe drop some weight before your next physical.Been using cpap machine for 11 years myself.DOT did not send me in for a sleep study.I and my wife knew there was something wrong so I went for the study on my own and Iam not overweight.Good Luck

It's also recommended you find effective medication if you have high blood pressure . It's recommended you get in a program approved by an SAP if you have a positive drug test .
You aren't forced to do what the physician recommends but you won't be qualified to drive until you do .Last edited: May 26, 2013

Dont quit your day job.
Sleep apnea is a very real and treatable condition. As to how many companies are coming to require drivers to test needs looked at hard. Weight can be a factor , but for me , in describing to my PCP what I was experiencing , it came down to actual effects and other physical indicators. In addition to my girlfriend witnessing my stopping breathing while asleep. At the time my weight and BMI weren't a factor.
If it can be mandated by DOT that there be a seperation between the clinics and equipment suppliers would go a long way to getting those that actually need this therapy the help that can save their life.
Untreated apnea is very hard on the heart and obviously dimished blood oxygen levels can damage the brain. -
I know that, but he did get a 2 year card. Then they said he should consider a sleep study.

I was tied because I spent 3 days on dam bus and was picked up at the bus stop and brought to medical exam.
The company notified DMV in my state that I failed my medical exam because of sleep apnea and changed my CDL to disqualified.
I went to the local sleep clinic in AR. and pasted with flying colors. I returned to company doctor who in turn passed me.
When I returned to the hotel there was a driver who already worked for the company in the parking asking how many of us failed do to sleep apnea? Come to find out the company doctor owns the sleep clinic and the only place in town to buy a machine. The driver wanted us to join in a class action law suit against the doctor. So, I did.
5 years later I received a letter saying we won, and I received the cost of sleep study back and $1,100.
Come to find out the Safety Director at the company was receiving a kick back and the tech who ran the sleep study was receiving a kick back too. They contacted over 250 drivers that had failed the sleep study and found only 11 driver really needed the machine.moloko Thanks this. -
Well, first of all, wrong answer! The FMCSA has set up a data base where registered DOT Medical Examiners must log in every DOT exam they performed indicating if the driver is qualified, temporarily disqualified, or doesn't qualify. So trying to "doc shop" won't work any more and will backfire. Secondly, falsifying or withholding pertinent information when filling out your DOT form is a federal offense. Doing so is a great way to lose your CDL medical card. As a DOT medical examiner myself, any driver who is non-compliant with the regs or who tries to falsify any information is guaranteed to lose his medical card because he is irresponsible and shouldn't be driving.

Quite a first post. Given the state of chaos in the medical profession you might not want to throw stones.......

The doctor turned around and left. The nurse came in about 5 minutes later with another driver and asked what I was still doing in the room? I said I'm waiting to be seen by the doctor, she asked me name and then she said the doctor failed for having sleep apnea.

I wonder how many federal laws might have been broken in this scenario ............Last edited: Jun 11, 2013
