DOT Audit and Logbooks

    Hi everyone i have a few questions about getting audited. Im a company driver and sometimes i have to bemd the rules. I drive locally pulling an end dump and more than once ive had to workore than my legal 12 hours. I havent kept a logbook since ive been local, just a time sheet, however im going to start, that way ill be able to legally work 14 instead of just 12. Im just a little bit worried if my company gets audited because i didn't have a logbook for the past couple months and i know i have worked over hours due to breakdowns and such. There are times and dates on my paperwork that wont line up with what i wrote on my timesheet. Im just wondering what kind of trouble i can get in for doing this. If the company does get audited and they see this will it go on my record? Is there a statue of limitations for this? For the future im going to keep a logbook even though im local and dont drive out of the 100 air miles. Sorry for the long post. Hoping to hear back with some info...

    Yes there is a time frame for this, company keeps records for 6 months, you keep them for 8 days. If the company gets audited they must likely will have to answer for the violations on your logs. I don't think they will come back to you UNLESS they are auditing because a accident or such.

    Just a disclaimer, I am not a attorney, just stayed at a "reserved parking spot" at a Loves last night

    Is there any kind of trouble I as the driver can get in if my company is audited? Like will it go towards my CSA score or anything like that if they find any log violations? To be honest the company i work for doesn't really care they are a small family run company and want me to run as much as i want..

    The driver don't get in trouble. The company accepts the logs. They get in trouble. IF ANY.

    And if there is ANY. The company will tell you.

    As for the 12 hours. You're limited to 11 and 14 just like everyone else. You only have to do a log after 12 hours.

    Your 12 hours include 11 drive + 30 lunch + 15 pre + 15 post inspection. If you work less then 12 you don't need a log. And you certainly can't work beyond 14.

    You don't need to worry about prior days. You only need to log the days you work over 12. Your timecards work as logs for days less then 12.

    If you DO work more then 12 and you have to log. Don't forget the 30 lunch BEFORE 8 hours. And no sooner then 3.

    so even though ive worked over my 14 hours without a log i wont get in trouble if they find it during an audit? i understand i need to keep a log after 12 hours and how to fill out the logs and all that im just not sure what kind of trouble a driver can get in if they find out about cheating a logbool during an audit. thanks for the help i just want to be surr about this because it has me worried is all. i know i shouldnt be riding dirty but sometimes i have no choice

    Audits inspect companies.

    Leo's inspect you.

    If you turn in a bad log. The company will tell you to correct.

    That's generally how it works. Not always how it works.

    Audits are out of your hands and none of your concern.

    Okay thanks for the response. Like i said fhe company I work for doesnt really seem to care about running illegally or not they just want me to run as much as I can. Thanks again.

    If you're under the 100/115 miles it's not a big deal.

    It's not the logs but your time card.

    If you get into an accident like the guy did in a city far north of me, they will pull your time cards and ask you and the company why were you driving beyond 11.

    This will also allow the door to be open for you and your company being sued.

    Don't know how often you went over your 12 but you are allowed a 16 hour big day once a week under the 100 mile rule. Also, you don't have a CSA score. The company you work for does.
