Do you need Authorety to haul product for yourself?

    Hi,

    I'm leasing on to a carrier soon and will not have my own authority. Am I aloud to haul freight that i'm not getting paid for? For example, If a family member is moving, can i used my truck and trailer to help them move or am I not aloud to carry any freight unless booked by the company I'm leased to?

    Further more, If i buy a small tanker, Can I haul NON-hazmat fuel for my own use? Again, not selling to anyone else or transporting for anyone else. Its for my own use. the company i'm leasing onto runs vans if that makes a difference.

    Basically, do i need authority to run product for personal use when i wont be paid for the transport of it?

    I might be a rookie but I believe the info I have is close to fact.

    First, if you're leasing to a company their lease contract will say what you can do with the truck when on home time. Some allow you to use it as personal use others don't.

    Second, I've thought about the moving thing too, I live in Florida and it may be different in other states, but I was told by FHP that if I wanted to help my friend or family move i would have to have the truck and trailer in my name, the tags would have to be registered as a recreational vehicle, and I could not be paid for it, even if they were paying my fuel. Of course you could have them pay you, it just wouldn't be on the books...

    Third, what is non hazmat fuel? I thought any combustible fuel was hazmat, unless you are carrying less than, I believe, 1,000 gallons then you don't have to display placards or be licensed to haul hazmat.

    Fourth, like my second statement, you don't have to have authority to run product for yourself, BUT your vehicle and trailer have to be registered as an RV rather than a commercial vehicle, AND you CANNOT haul anything you would be paid for.

    Example, you CAN haul your own belongings somewhere. You just can't haul your belongings somewhere to which they would be sold. You follow?


    If I'm wrong in this and someone knows the correct info please correct me, I'm just posting what I've been told by my state.

    The short answer is NO you do not need COMMERCIAL authority to haul your own furniture ( no you do not need HHG authority if YOU OWN the goods). The bio issue is different, you are dealing with haz-mat if it is refined and cleaned. You need a placard when over 119 gallons is being transported (not counting the fuel you have in the tanks on your truck for powering the engine). Its a green and white placard with a green flame on top. You also need a 5 million dollar PLPD insurance policy and haz mat authority from DOT.

    You do not need haz-mat authority or 5 million in insurance if it is unrefined (straight out of the fryer at McDonalds).

    Geez,I moved my #### all over the country and even put my Beamer in the load. but I was a bedbugger for 30years so never had an issue...lol:biggrin_2559:

    Stapes; I am not sure you are right about this. I just had this come up at my biannual Highway Patrol inspection here in Commiefornia. The officer said driving home after unloading needs to be logged and if you are out of hours you must stop, just like you would loaded. Can you check this out?

    One he is not a household goods motor carrier and ...

    You are subject to this part only when you transport household goods for individual shippers by motor vehicle in interstate commerce

    He is not engaged in commerce. Nobody is paying him to move his own furniture.

    That's what I was thinking, since he wouldn't be involved in any commerce it is then not a Commercial Vehicle Correct?
