Do not use your Jake brake in our town,OR ELSE!!!

    So here's one for you truck seat lawyers. You have towns all over, with no engine break ordinance posted at the entry point in to the community. And noise laws enforced,how much of this could really hold up,as far as getting a citation an sticking . I understand why they have the ordinance . My truck came from the factory with the Jacobs engine break on it. It was meant to be used for different operations of the vehicle. Federal laws govern vehicles that are manufactured, we operate under a lot of Federal laws.How can they tell you, you can not use a device that came on the truck. I use it anyway ,an will fight it if i get a ticket,I see it as no difference as them saying do not use your lights,turn signals ,wipers etc,they cant .our truck is muffled for now, till it needs pipe work then straight goes on.an i am sure the ordinance is there due to straight pipe. if they want to have that ordinance, then reword it no UN-muffled pipes blah blah blah.have you got a ticket for violating this someplace, what was the out come,? paid it an said F you,instead of missing work?i will fight it because prove beyond a reasonable doubt it was my truck jacking down that hill proof is on the city an state.

    Jakes never bothered me. Actually could care less if I got woken up by a nice sounding jake. Now ricers with fart cans on their lawnmowers, THAT is audio assault!

    Over the last few years I ignored those signs if I was in a truck with a automatic tranny. There were units in the fleet with auto’s, no trailer brake bar, and no jake brake, needless to say I didn’t take those units too often.

    I use mine all the time in those places. But I don't try to wake the dead or have them on high pulling out of the fuel island either.

    The signs are primarily a noise ordinance. I've never been stopped for using jakes in any town but they aren't that loud. The ordinance was (most likely) written because of the richards who try waking the entire community with unmuffled pipes. Try running through a small town with an insomniac cop and let the unmuffled jakes rattle, I'll wager you receive a citation.

    The ordinances vary enormously by locality. Some allow a compression brake(Jacobs Engine Brake is patented device and trademarked, many towns have been successfully sued by Jacobs for using the trademark name) in emergencies, some with mufflers, some without. Whatever the written ordinance, the details are not fully on the sign.
    Go ahead and get your ticket. Go ahead and hire a lawyer to fight it. In that court of law the town will bring a parade of expert witnesses, including one from Jacobs Vehicle Systems themselves that will testify using an engine compression brake when the vehicle is on level ground in speeds less than 35 mph is an improper use of the device, in addition to being a source of noise pollution.
    Here is a quote from the operators manual provided by Jacobs:
    Flat, Dry Pavement If you are driving on flat, open stretches with a light load and greater slowing power is not required, place the progressive braking switch in the “Low” position

    note the use of the words open stretches. That is intended. Their lawyers told them to write it that way so they can say "we tell them not to use them except in open areas" . They are off the hook, you are not.
    I am not a lawyer but I watch them on TV.

    Nothing more annoying than some idiot in a big truck rolling through town or a truck stop waking folks up with his extremely loud jake brakes on.

    Absolutely uncalled for ignorance.
