Company wants to hold my money, is this legal?

    Hello people, my company sent me this message, that says they needs my repair receipts of my truck, or if I not gonna give them , company not gonna pay me, who knows is this legal? Thanks

    "Dear owners of the truck. I know the truck is yours and you do repair it. But, as of you drive your truck under our signs DOT requires our company to collect repair receipts and make sure your truck in the good working order. Please, make sure you send all of your repair receipts to us by the last Friday of the month to make sure that your payment will be made on time! Have a great day"

    Are they reimbursing you for the repairs? If you haven't done anything illegal, what's the issue?

    No,They CANNOT legally hold your earnings for any reason.
    And if its a reputable company,THEY KNOW THIS!!!

    If Your working for some 3-7 truck carrier "Down on the farm" Where they do things as if nobody can tell them what to do- I can see such a ridiculous statement being said.

    Bottom Line- No They Cannot withhold any earnings for any reason if you are an employee, They have the option to terminate you for not following orders to produce receipts as requested.

    I've never seen it put quite that way. They could if you signed something saying you'd send copies of the repair work orders in as a condition of your pay. Otherwise no it's not legal, they can't just withhold your money.

    DOT does require keeping of maintenance & repair records though. That part is true. They inspect them at time of audit. I have to send mine in every 120 days. The company won't withhold my money if I don't, but they will not allow me to move any freight until I do.

    Read your lease agreement. This should be addressed there. They are required to keep on file all maintenance records, lease truck or company truck. What's the problem giving them what they are required to have from you? They have to have some sort of leverage if you're going to be difficult and/or negligent.

    As I read it the OP is a L/O. Therefore he should read his contract as this situation may be covered in it. Regardless, the carrier needs to have the records as they have indicated.

    If you are involved in a serious crash, one of the first things investigators and attorneys are going to demand from the carrier is ALL the maintenance records on the truck and trailer involved. "We don't currently have them available" is not going to be a good answer.

    Furthermore, if you are dead or otherwise incapacitated, or your truck and all the records you allege to have burn to the ground, then what?

    Plus, it's not like you need to send in the originals. Make a copy, send it in with the next trip pack, or once you get to the office...

    I don't know about holding money but they are required to have all copies of repairs done every month.Usally you'll fill out every month what repairs you did and make them copies of all receipts of parts if you did the work or repair bill if a shop did.

    Whats the big deal,send in receipts with your load info.Would you reimburse your drivers if they didn't have receipts?
