COD payments

    Good morning, i have the following situation: I got a load with cod payments (cash on delivery) and th driver did the delivery but consignee refuse made the payment for something wrong in the machine. Broker will no pay because the rate confirmation said " $ X COD" ( and he isn't responsible for not payment of consignee. Any idea what can I do?

    I used to have to collect payments which I hated, but before I put the truck in the dock, I would tell the receiver/consignee payment is paid first, not after. I had one issue with this, all the others paid.

    Yup. I had a few of those on end dumps. Payment had to be made before the load would be dumped.

    No check/cash/whatever prearranged payment form= nothing comes off the trailer

    Wonder if his driver allowed receiver to unload before getting paid? What to do is this happens, unload before getting paid? What recourse then?

    Well.. You did not uphold your end of the contract, so why should the broker pay you? Once receiver refused payment you should have gotten ahold of broker to see what to do with the shipment. Since you gave the shipment away it's all on you.
    You might be able to sue the receiver to get the money and if the court actually sides with you in 10 years of fighting you still will not be able to get paid by the broker as so much time has gone by.
    Next time do what you are contacted for, and if you don't know how don't accept the contract.

    What is wrong with the machine?
    Was it damaged in transit?
    Did you unload the machine or is it on your trailer?
    You could request payment from shipper.
    The only real option you have is to sue the customer for the freight.
