I've been looking around and see that non payment of support can lead to losing your CDL. That is understandable. My husband just started trucking and we are trying to figure out how child support will be calculated. Since it all depends on miles it would differ from week to week. Any insight?
Before I get yelled at for him needing to support his children, he does, has for years and still does. We also have our own child together and a one income family as of right now so we are just trying to make sure everyone can be taken care of. Not just the children he pays for in child support.

well it all varies by state but here is my experience. In Michigan you can get behind to a certain level before they have a hearing to grab your CDL. If the company he works for has an order to fulfill, if he has an off week or takes a week off then no support is sent that week or it will be caught up on the next check. If he's working for an upfront company there is no getting around the support.
If you feel you are paying to much support you should be able to go to the friend of the court where the order is at and have a review done. Sometimes it's not fair for your new child that he has to pay for other children unequally. It is possible to have him pay support to you as well to equal things out (lol, seriously).
I personally despise the system....contact your local people for sure for best advice, it does vary by location.kbar909 Thanks this. -

If he already has an order to pay why would it change because of a new job? It should stay the same until the other party wants to modify the order...which in the state I pay (MD) is every three years.

When I was paying in sc variable income didn't matter. It was a set amount. Pay this much or......
even when I took a job making 25k less ( only thing going after being laid off ) I was told by the judge it 'wasn't his problem I couldn't pay my bills I should have gotten a new job earning to my historical potential income'. Yeah right. But I digress.....
If he's already had an amount ordered by the court that's it. Best you contact the clerk of court or whoever is responsible for support matters in the jurisdiction where the order was issued and they can guide you better than anyone of us here what your options and recourse, if any, are.

in michigan you can request a review due to a change in circumstances...in michigan that could include a job change or the addition of another child to support. in fact, if you have your own children and support non custodial children in michigan it will change the formula. there is no guarantee in a review that the support will change. I've never done the review, just paid it. I only have a few more years to pay and it will be done. I'm absolutely sure in the end that my daughter will be far worse off due to the governments involvement in her life. In fact, over the last 8 years my relationship with her has for the most part become non existent. Its really a shame but it was also not the way i was raised. My ex wife, being the liberal, thinks the government would save her and she could exist nicely with an entitled free ride. She is and has learned the consequences of her decisions. haha you got me started.

Most Judges will not take a CDL for back child support as it makes it even more difficult to get caught up without a means to make money. Most states have a max amount that can be taken from a check, but the system isn't smart enough to automatically catch up if he has a good pay check for getting behind in previous months. It will be up to you to send checks to the court or mother to make up any shortages.

It will be up to him to send checks to the court or mother to make up any shortages. Keep records and spreadsheets, most states have online access to child support info so you can see payments real time and the status of your account with a login and password.

Last time I switched jobs I called child support to make sure there were no hiccups...case worker said if I sent anymore money that they would have to start sending it back cause I was way ahead. I thanked her for her time and promptly sent more money...I don't trust that system one #### bit.
