So my husband was driving in NC and he was talking on the phone. His headset died and he answered because I was calling and he usually answers because we have kids with special needs and always wants to make sure everything is ok. He got a ticket. Is this a moving violation? he has called a lawyer, the highway patrol, the DA's office and the DMV and nobody can tell him if it is a moving violation or not.

I don't know if it's a moving violation but I know fines can be steep.But nonetheless unless it is an absolute emergency you should have husband call you from now on.Next time it'll be worse because it'll be his second phone violation.Also his company may have a policy against talking on the phone while driving.

Not suppose to be using any electronic devices while operating a cmv.
That says it in a nut shell. -
It's probably a $ 2,750 ticket for him and a $10,000 ticket for his company.
Odds are he will be fired.

That's not a cheap ticket... And I am pretty sure the Carrier also gets fined. Usually it's hard to keep a job after that ticket.
