car transport accident.. how to go about filing a claim?

    Hello so this is the short version I bought a car and I hire a company to transport my vehicle while in route he gets into a accident he calls me and tell me that he got into an accident(ran the truck into the woodline), based on him my vehicle suffered heavy damage and it will take few days to deliver the vehicle he says that after I pay him I should start a claim with his insurance,now you as professional drivers should I pay him and what steps would I take?

    Interesting, I'm sure he won't take the car off the rack until you pay him. Was it insured by you also? Call his company ask for their insurance company claims department. If yous start a claim you also need the police report. Get pictures, lots of pictures before he takes it of the rack and after.

    When he picked up the car then he had to fill out a bill of lading that shows a car, where he has to mark any damages that were already on the vehicle. When he delivers it to you, then you get a sheet, where you can mark off showing the damage he done to the car. I would take pictures of the vehicle on the car carrier to show that it was delivered that way to you, before he even takes it off of the carrier.

    You do have to pay him in full for the transportation, and I don't know what type of car carrier you got (individual who owns his own truck or if it was a company) then you will have to file a claim with their insurance company and that should fall under the cargo liability.

    Yes you need to pay the line haul fees, he was straight with you on how to do this. Be sure to get cargo insurance info to file your claim. When the vehicle gets to you take a lot of pictures, make sure it's all noted on the BOL and keep a list of the expenses you spend while you have this taken care of.

    but don't forget to take pics while it's still loaded. as mama suggests. that way you cover your butt and prove that was how it was delivered.

    And I don't know if he has a copy of the police report or not yet, but make sure you find out all the information as to where, what road, mm marker, etc, the city and state and who the report was written through,ie the city or state police.

    You probably need to make sure you get all his correct info as to name, etc. Address may not work if he moves or changes places a lot. Any info you can garner is better.

    Personally, I wouldn't accept it, just as if ordering something by truck, UPS, FED-EX, USPS, whatever. I've refused damaged items in the past and to me, this would be no different. I may accept it AFTER the insurance is filed and all my T's are crossed but not before. Try and see if you can get everything filed ahead of time before the vehicle arrives. See what the insurance company tells you. Just to cover all bases, call YOUR insurance company and see what they tell you. I'd go by that.

    Good points on here; refuse to accept the car.
    Receivers do it all the time for damaged freight.
    Definitely call your ins. company before signing anything.

    how the real world and how the receiver works are two diferent things.

    you can reject and fight for a refund for products damaged through ups and what not.

    but how do you reject a car you've already bought and paid for. and none of us know what he even paid for that car.

    if he bought it from another person. do you think that guy is going to give him his money back. he probably has pics of his own to show that car left his property in PRISTINE condition.

    he's stuck dealing with the truckers insurance.
