    That non preventable is there because the FMCSA says ALL accidents must be reported and most companies think that means to DAC.That even includes a stupid low tree taking the company owned CB/AM/FM antennas on those Cheap Freightliners off! It also includes a bird hitting a windshield and shattering it. A Qualcomm report where a turkey flew into the side of the truck and left a 30 pound dent in the side of the sleeper behind that little window and other small stupid things that a moron safey director thinks needs to be reported because she had to write her report and it cost the company money to do that or to repair some of those things except for the turkey but it was still reported! AND where some yoyo lost a really nice ladder off his P/U in front of me and I straddle it and didn't hit it but the car behind me did and I sent in a message as to what happened in case the car decided to go for the money from the company! I mean I didn't even send in the macro for an accident just the open letter #1 macro and that stupid broad put it on my DAC! After those stupid deals unless it involved another vehicle like getting hit in the rear by a dump truck on the BQE or a car that tried to pass me by driving under my trailer and other non preventables I shut the hello up!

    The reason why they report to DAC?

    DAC pays them to do so! They either pay OR they give a reduced cost DAC Report on an applicant!

    This is why I feel that any report made to HireRight MUST NOT be done by clicking on radio buttons for the "offenses" BUT should be made by typing a 500 word real document explaining the offense in detail! And NO cut and paste for some cover letter! That's why I feel that HireRight should also run a plagiarizer check program on every one of those reports they get! Make both of them have to do actual work on sending a BS DAC to them and HireRight must spend money making sure that BFI isn't writing the exact or close to the same thing just to get a few dollars off the cost of a report! They SHOULD be doing it the old fashioned way and calling the last employer as the FMCSA states not just buy a DAC! When it costs those bloodsuckers to report on you they will change the way they operate and when it costs BFI company to make a report instead of clicking a few radio buttons in a website they'll darn sure change their ways! They might find that it's cheaper to just make a call and do what a good safety office used to do!

    NOW! You see what I just posted? Copy it and then send it to your state reps, your senators and congress critters! The more letters they all get the better the chances they will make life harder for HireRight and just might put them out of business which in my book is a good thing!

    Hopefully this little class action will get them close enough to the edge that if congress were to actually make them do the above that will push them over the edge! yes a lot of people will lose their jobs and a few who thought up that scam will have to come up with another but as far as I'm concerned those who work for HireRight are as bad as those who work in collection agencies harassing the unemployed who can't help the fact they lost their job and can't find another on!That's life right now! If and when things get back to working then call but heck half of them were unemployed and doing what most of the rookies are doing. Taking any job they can to live!

    Why the heck are "NON-PREVENTIBLES" listed on a DAC???? I may not get hired from USX now due to that thing being on my DAC.. They want me to provide a accident report...hello,,the vehicle never touched my truck, a witnesses statement was the same as mine..the lady was on her own..I just pulled over because I saw her wreck,,but now it is listed on my DAC as me running her off the road and a NON-preventible... What a pain in my bleep bleep bleep

    Off topic but bosses always don't believe "a bird hit the truck" storys they want to hear a story that puts all the blame on the driver, like the time a lot lizard hitched a ride behind my sleeper cab to be seen at the Manchester Tennessee scales, lol she told the cops who were called that she wanted to get a ride to the TA and I would not let her ride up front. People want to believe it's the driver's fault (they NEED to believe it), crazy stuff happens to truck drivers.

    The problem with Hire Right is that they were allowing truck companies to file false reports that were trumped up by the truck companies. After all, Hire Right was getting their money from the truck companies and the individual truck driver couldn't get the DAC report changed. Even when the charges were most questionable, Hire Right would always side with the company.

    I had one such case where I had an actual witness to an accident and the company filed a report that was highly prejudiced with errors. The real problem is that I had quit them without notice and they were after paybacks. I've heard many similar stories from other truck drivers, so this isn't the first time.

    I will be filing a report soon. I don't need any money, but I think we all can do without the trashy Hire Right outfit.

    The best way to hurt Hire Right is to hit them in the wallet until they die. If you don't need the money, just give it to charity and they'll put it to good use.

    @managerdan

    This case Ryals v. HireRight, from the settlement offer is not in anyway have to do with DAC, in my 20 + years DAC was not a problem unless a driver left a truck somewhere and quit, failed a on the road drug test, accidents etc. From what my sources tell me and I have not seen the case file HireRight changed their business name from USIS to HireRight about the first of the year of 2008, all or most of the USIS documents was shredded from USIS about the time the lawsuit was filed that is why HireRight can't go to trial and is offering the settlement, DAC name is not in it.

    You needed to have took action via letter directed at HireRight or had a action pending between 2/2/08 - 9/30/10, if you have the documentation that shows the faulty report that's 1 violation, you can file a direct claim and argue that at the fairness hearing on 11/2011 (read your notice) and look at the more detailed one online. Hell if I was still driving I would laugh at this the money I used to make driving.

    I got one in the mail that said if I did nothing I would get $40 or something like that. I really didn't read through it. I never personally had a problem with them but I only worked for two companies in seven years before I became an o/o.

    Is DAC even a company? I thought it was just a database maintained by hireright. So I'm not sure what the point of saying that it's not on the lawsuit over and over is. Suing "DAC" would be like trying to sue your MVR.
