990 Gallon Diesel Tank Trailer - Legal Requirements?

    Looking at buying a 990 Gallon diesel tank trailer, unsure if there is any DOT requirements before I can tow it, it will be used to refuel our equipment onsite.

    Placards with the correct class of liquid matching what you have in the trailer and on your BOL specifically. You will need a 24/7 valid number of response in case of a leak problem among other things. You will want everything on that tanker to be a metal that does not spark.

    I believe there may be inspections or testing that tank will require. Check those and see if they are fairly recent and valid. If not? Test them again and fix it if need be before you put it into service.

    Make sure all of your nozzles for refueling are in good condition and so forth. Same with the pumps and metering.

    It's not a bad job at all. Just alot of routine. And it's definitely HM for your endorsement etc. Review when you have to get a renewal on your DOT medical. And so on etc.

    this is 990 gallon, my understanding is that under 1000 gallons you don't need a cdl to carry/tow this trailer?

    At 119 gallons you need a tanker endorsement.

    Which combined with hazmat will result in a special X endorsement on your CDL.

    There were certain minimums at which you do not need hazmat placards but I have not been endorsed as hazmat since leaving OTR work back in 2001. Had a dispatcher abuse me verbally over time wasted on lawful and required bypass routes around a city, I had quite enough of him. It was getting to where those loads were a good deal of mental and physical attention to detail beyond what I thought they did not pay me enough for. I was very good with that stuff in my time. Zero issues. With a couple of stories that might argue that yes there were a issue here and there.

    Regulations apparently changed in 2017 many states have had their DMV's follow the minimum 119 gallon rule for endorsements required to have tanker at that capacity and beyond. The old 1000 gallon limit pretty much gone away, the 119 gallon minimum pretty much ensures all tankers on the road today will have a endorsement and hazmat where applicable.

    Not sure who the carrier is in this case, or if it is an individual wanting to do this, but it is very possible that registration as a MC is required, and also as a hazardous materials hauler, in which case insurance just got very expensive.

    The 119 gallon rule is relatively new, in effect for only a few short years now. I see local people hauling a couple totes on Harbor Freight type trailers all the time, I seriously doubt any of them have a CDL or tanker endorsement for their dually and small trailer. They never get pulled over from what I have seen, just as RV'ers never get checked for those that require a Class A license. Only the 'big trucks' get stopped.

    Here in Arkansas the Law and Revenuers (Yes we use that word, same as the DMV) lean on the little ones, the hotshots. Once in a while we catch one who thinks to buy a old dodge or one ton and proceed to run loads like a big rig. Until they get caught with a stack of tickets beginning with driving without valid CDL, then without valid class of vehicle working the way through the weight violations, securement violations, hazmat violations and on and on and on. All the way down. When the courts finish with them those good old boys are no longer interested in that kind of work.

    I can install a fuel tank up to 120 gallons in the truck secured correctly and so on and it will not be a problem except in Jersey potentially on the pike where generally people are not allowed to carry extra fuel (To make sure you stop and buy the overtax gasoline)

    Even though I have room for that 120 gallon tank, the #### thing is going to be 800 pounds or more. It would wipe out and defeat the purpose of having a truck at all. There is a GM Pickup that is almost equal to a S60 detriot in specs soon to be sold and able to endure 32000 pound rating for cargo etc. If I had unlimited money, I would have one on order. We can always use a good truck here in Arkansas on a basic car license. Those trees don't chop themselves without it.

    The NY thruway is the same for no extra fuel. Had the state police called on me for trying to get gas in a can once, it was to take over to my truck to power my generator. Had filled gas cans for years on the NYTW with no issues until that one day. Same rules in NJ about no gas cans allowed.

    A tank permanently attached to a vehicle (not carrying liquid as cargo to be delivered) gets exempted from HM regulations under the Materials of Trade classification if it is used to assist in powering the vehicle or other functions on the vehicle (for example generators).

    If you read all three point in the link that x1Heavy posted , I don't believe OP needs tanker endorsement. The three point are if containers are over 119 gallons each, they must be full of product and all total containers must exceed 1000 gallons. He meets one and two but does not meet the over 1000 gallons. Technically he can carry 8 containers at 119 gallons each and not need tankers endorsement. Anyone else see it this way?

    Ok.. this is where I tip my hat and say thank you for your thoughts. Ive reached the end of my HM knowledge regarding the points you raised relating to support of vehicles or generators on site with a road vehicle tanker of fuel. Someone else here on TTR, or many someones will be happy to help you know for sure the first person I would probably look at is @moose

    I believe that law came into effect during the Arab Oil embargo of the 70's. In NJ .
