16 hour rule?

    I never knew about this until I started my new gig a couple of months ago.

    Apparently, if you’re away from your home terminal for 5 consecutive days, you can use the 16 hour rule.

    I park near my house every night so I’m always away from the terminal as far as the logs are concerned.

    Tonight, I’m in Jackson, MS on a rare over night trip and my ELD says “You’re out of on duty time, but you’re eligible for the 16 hour rule. However, you must return to your terminal and go off duty within 1:18.

    It did say 2 hours, but has been counting down.

    You have it slightly backward, the 16 hour exception is for local drivers, meaning you have to leave from and return to the same place that trip as well as for the last 5 consecutive tours.

    It only extends the 14 hour clock, does not extend the 11 driving hours.

    I never try to use it. I didn’t even know about it until I saw it pop up on my ELD.

    I’m home most nights (out over night maybe 2 or 3 times a month). I think it pops up because I leave and return to where I park (2 miles from my house) every day.

    I’m 200 miles from there tonight. Lol

    Yeah, most companies won't tuen on that feature for anyone except daycabs, too tempting for a driver to misuse it. Great for the local pickup and delivery driver that has a bad day with traffic or a breakdown. Other than that pretty much usless.

    Don't think you are making it back home 200 miles in just over an hour unless your truck has wings!

    Here is the criteria.
    1. Left and returned to the same spot the last 5 duty tours (work days)
    2. Not used it since last reset or last 6 days
    3. 16 hours on duty "window", still the same 11 hour drive time.

    Here is the actual regs: eCFR — Code of Federal Regulations
    (o) Property-carrying driver. A property-carrying driver is exempt from the requirements of §395.3(a)(2) if:

    (1) The driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked;

    (2) The driver has returned to the normal work reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive hours off duty; and

    (3) The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by §395.3(c).
