16 hour rule??

    So.. I think... If I have started and stopped in the same place for the last 5 days and been within my 14, I can use a 16 hour rule (not exceeding 11 driving). I had the last 5 days off, so can i use my 16 today? I documented it in my log. I was stuck at shipper for 6.5 hours. bla bla bla.....
    If I am wrong on this and you would like to explain it, PLEASE try to make it easy to understand. Thanks for the input.

    What did you do the PREVIOUS 5 days prior to the 5 days off? The 5 days off count as a RESTART, so you have to go back TEN days.

    16 hour extension only applies to city and short haul drivers that start and end each day at their companies terminal. OTR drivers do not qualify for this extension.

    You have to be relieved of duty at the same place you started every day to use the 16. You can only use it once a week.

    Generally if it applies to you your company will have a pretty clear understanding of how it works.

    Days off don't count as "duty tours". What you did before those 5 days is what determines if you're eligible for the 16 hour exemption. Like white dog said, you'd have to go back 10 days.

    Local drivers get a 16hr day once a week if they meet criteria.

    (o) Property-carrying driver. A property-carrying driver is exempt from the requirements of § 395.3(a)(2) if:
    (1) The driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked;
    (2) The driver has returned to the normal work reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive hours off duty; and
    (3) The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by § 395.3(c).

    So need the last 10 (or more) days to get the last 5 tours. You will also need to be starting and stopping at the same "normal" location. If you are dispatched to go to a dc and use that as your base, I'm not sure it would count to allow the 16. But, and I know it is late, you should call your safty department 'cause even if you are legal you could be violating company policy by taking the 16.

    If you stayed overnight anywhere other than your home base before your reset you cant use it.If you normally return to base everynight and return to base the same night on your 16 hr " short haul truckers exception" it works well. Still only 11 hrs driving though
