150 mile New AG Rule

    So, now the new rule for AG products, including produce, makes it possible to drive 150 air miles to a cold storage, DOT considers that a source same as a farm, and a 150 miles away from the cold storage without it counting as drive time during harvest seasons.

    So, now with e log the 1,000 mile day will be legally possible.

    I might buy a refer.

    Goes into effect June 18th.

    Having the capability to run a 1,000 miles a day should greatly enhance safety, especially on the trips where you do 150 exempt away from cold storage, drive 700, then 150 exempt inbound to the cold storage that's the dc.

    I've done that. From the farm 150 miles after loading. The eld needs to be turned off though. Their is an app to show you 150 mile radius. But it's only in km, 241 km is 150 miles. App on android is called map radius.

    • When operating within the 150 air-mile radius the driver can either identify the movement of the commercial motor vehicle as authorized personal use on the ELD or refrain from logging into the ELD.
      • If the driver logs into the ELD and identifies the movement as authorized personal use then driver must also make an annotation on the ELD explaining that the movement is exempt per the agriculture exemption. Upon exiting the 150-air mile radius the driver must then identify the movement of the vehicle as on duty driving.
      • If the driver does not log into the ELD while operating within the 150 air-mile radius then upon exiting the 150 air-mile radius, the driver must then log into the ELD, identify the movement as on duty driving, and make an annotation on the ELD explaining that the unassigned miles accumulated prior to that point were exempt miles.
    ***Just turning it off, isn't good enough. Still have more work to do (notes)*** You're better off, just using P/C as outlined by the FMCSA, to explain and justify the Miles.

    Even using pc you want to annotate it. That way when the dot guy looks at the log he knows it's valid and not an abuse of pc.

    Yeah, well, not QUITE. Yes, you can do a 1,000 mile day, but probably not from cold storage. It has to be an agricultural commodity, and that means not processed, graded, packaged or frozen. But, pick it up from a farm, silo, sale yard, you're good to go. Second, inbound loads are not covered by MAP 21. And, as mentioned, it has to be during the state's official planting or harvest season.

    We just picked up a run from Iowa to our farm in Eastern Idaho. Since we are a farm, that makes the truck a qualified farm vehicle. That makes the last inbound 150 HOS exempt, too, and not just during harvest season. Anyway, that run from Iowa is right at 1,300 miles, and yes, we can do it, legally, in one stretch, as long as we can do 697 miles on I80 in 11 hrs.

    Which is NOT what we are going to do, but we'll probably do an 8 hr break instead of a 10, using the HOS exempt hours for the 2 hrs to do a split break.
