    why do most guys around here hate them?
    From where I’m at a lot of businesses (small businesses) use 1099 employees as a way to bypass having to pay worker’s compensation and benefits etc. It’s pretty common where I’m from.
    Are there other reasons or is that it?
    Someone point me in a direction of a company that would hire a tornado on legs. (I’m not looking, I’m currently employed and have a line of prospective employers who’ve green lighted me)

    No one needs a tornado on legs, except for those 1099 companies you seem so fond of.

    Good companies need safe drivers that they are willing to support fully.

    You’re misunderstanding. I think the whole 1099 thing and “terrible” company crap has been exaggerated.
    Because I’m not seeing anything.

    For one thing, in most cases it is illegal. You are being treated as an independent contractor when, in reality, you are an employee. You say the companies do this to save on taxes and you are right. And the 1099 guy is the one that pays these taxes. You pay your Social Security and also the companies matching amount, You are not covered if you get hurt on the job, unless you carry you own workers comp insurance. And not eligible for unemployment in case you lose your job. Many of these companies hold money out of your pay (escrow) that you will in many cases, never see when you leave the company.

    There is no upside for you as a 1099 employee and you shouldn't be sympathetic to "small business" that "bypass having to pay worker’s compensation and benefits" because while they maybe saving a few thousand dollars, you certainly are not and they put you at serious risk.

    1099 means YOU are responsible for ALL your taxes state and federal. Self Employment Taxes (Social Security & Medicare) Health Insurance, Retirement, Life and Short/Long term Disability Insurance etc. So while they're not paying their fair share of those items they're also not paying for your un-employment and workers compensation, which means if you should get hurt it's on you. You have nothing to cover the cost of lost wages, if it's an on the job injury, you have no Work Comp to kick in and some health insurance companies will not cover work related injuries, regardless if you have worker's comp or not.

    So while you're "employer" saves thousands of dollars, he's shifting all of those cost to you and chances are he's not paying you enough to cover all of those expenses or he'd have you as a w-2 employee to begin with.

    You would have to pay all your health care.

    Even paying like 150.00 a week my company still pays most of it.

    Also I get a match on my 401k contribution.

    And yes unemployment too. Not that I would need it. If I get let go I just go get another job. I dont use it, but its there.

    In general, the trucking companies that use 1099 drivers, rather than employee drivers are dodging taxes and they are doing this because the companies are on shoestring budget. The IRS finds tons are employers are fraudulently using 1099 when the drivers are really employees. The IRS has a 12 point checklist to determine if the people doing work are employees or independent contractors. If the company determines what work, when you work, you aren't free to work for other companies, etc you are an employee. The boss can call you a tea kettle, that doesn't make you one.

    Most drivers new to 1099 work only later learn from the IRS that the checks they were paid were gross paychecks and you now owe back taxes from the date you started until the IRS finds you. BTW, the IRS will find you, and they will usually find you just before 3 years have past so as to get maximum penalties and fines. If you are 1099 you better be saving 30% of your check and you better be paying quarterly income taxes, worker's comp, both sides of Social Security, plus whatever your state requires.

    Well you haven't been around much.

    Most of the fleet owners who 1099 their drivers are cheap b******s who don't need to be in business. Many people like me who use 1099 do it legally and avoid having the sweatshop fleets.

    So you have employees and use 1099 legally. How do you do that..if you care to elaborate? One way i guess would be to put driver on "lease to own"? I know some do that. The drivers i know on 1099 do make a nice check,and slightly more freedom, just have to keep up on their paperwork and taxes. Of course they do forfeit the mentioned workers comp , and unemployment etc. Bottom line is, just curious.
